Rosemarie | Landlord Entering Apartment Without Notice? |
Last night my landlord entered my apartment to turn out a porch light I had intentionally left on (I'd be returning late that night and if it's not left on, crickets cover my door). I received no phone call to ask permission to enter, or at least notify me afterward. When I arrived, I also saw that the door had been locked improperly, adding to the trouble of escaping the bugs.
This is an illegal apartment in a private home, and they are nice people thus far, but this feels like a violation of space. I have only lived there for a week and don't want to seem troublesome, but I'm worried about what they may feel entitle to do if I let this slide. Trying to settle and dealing with bugs is stressful enough. So I feel I need to do something.
Is it reasonable to confront them on the issue? Does any one have any advice on how I should do so? What boundaries should I expect since this is a private home? Additional Details I am paying month-to-month, and the technical aspects of renting are a little "casual". No real rules have been established other than paying rent on the 1st. |

Confront is the wrong word for this situation. Just explain you left the light on because you knew you would be back after dark. I'm sure they thought they were doing you a favor by turning off the light. And explain that unless the door(s) are closed properly the bugs get in.
I would put off asking them to stay out for a while. If they keep coming in you may have to explain you want your privacy. Over time you may become friendly enough, family enough, to not care.
If they insist on coming in and you can't stand it your agreement lets you move out, apparently, without forfeiting the usual 2 months fees, last month and deposit. SO, take your time and find a better place, if necessary. |

Just tell him you think someone was in your apartment last night as things had been disturbed. See what he says. If he said it was him, tell him you would rather NOT have anyone in your apartment without your permission.
In a LEGAL apartment ( you said yours was not ) the landlord only can enter in a dire emergency ( Fire, broken water pipes with water coming out the door, etc) |

Oldest renters story in the book!
Since you know it is illegal you are not protected by any laws. |

RoseMarie - Hello, regardless of how U pay, They rented it to you & must obey the law. They must give written notice unless its fire or flood type emergency. This includes keep unit free from all bugs & staying out of it unless U give permission. That light is yours. Do they have screen on the door or, better, enclose the porch? People do feel unless U complain they will keep doing it. Definitely confront them if they dont agree. Take your case to lawyer. U r now the owner, for the term of rental and r entitled to quiet enjoyment, meaning they must respect your privacy. All homes are private 'tho some have managers. The landlord must deal with making it legal, or not. So anyway, Good Luck. |

if you have a lease and are paying rent then you have tenant rights which they violated. Technical they were breaking the law and you could of called the cops. I would give them a nice but stern warning to never do this again. If they give you any flip about it then you need to decide if you should just break the lease or if it is something you can deal with. |

You should expect the full rights of a tenant. But, with an illegal aprtment you have trouble enforcing your rights without being forced by the city to move out. Just complain loudly and forcefully and lay down the law. It's a bluff, but it might work. |

You need to talk to the people you are renting from, tell them you want to keep the light on that the dark causes a problem with insects and it also it makes for a safer way for you when you come home as its getting darker at night.
Tell them if they are worried about the bill you will pay them an extra $5.00 if they are so worried about the electric bill.
They should not deny you peace of mind and your safety, the dark can attract all sorts of undesirables not just insects! |

You are in a private residence. Is it completely isolated from the main structure of the home so as to be considered separate? Do you pay your own bills or are they under one payment for the rent? Do you have a written lease? Are the boundaries of the term clearly spelled out? If renting a room, there is usually no formal lease agreement. There is usually no term of boundary written as other parts of the home may be open to your use. Normally, just a cooperation between leaser and leasee is all you have to go on. If you are worried for your personal safety, then find a new place to live. If it is just an inconvenience, maybe you should just sit down and talk with the landlord. They will most likely understand about not wanting to have bugs coming into their home! Hope this helps. Free advice, guaranteed or your money back! |

i know in the uk the landlord must give you written notice that they will be visiting the premises, so i would ask him not to do this in the future as you pay rent on this dwelling , this is in you rights and interests, mention to them that you were afraid as the door was not locked properly and the light was out and this scared you . good luck. |

READ your lease.
Who pays electricity? LL may have done this because they pay the bills. TALK to them about it, and offer to pay extra to leave your light on. Explain why you are doing this. Talking to LL at beginning is best thing to do, be open and honest. |

I feel the same way, because it happens to me as well. I am not sure, but I think it's legal because an apartment is not a fee simple estate like owning of a house is.
--I would definately confront them about this. It never hurts to find out for sure, and to let your opinion be known. |

Technically thats breaking and entering.
You definitely should let them know that if you are not home you do not want them in there.
The fact that it is an illegal aprtment is a separate issue for the landlord to deal with. Thats really not your problem.
I would check your lease (I hope you signed a lease) and make sure there are no permission to enter clauses buried in there. Sometimes landlords put permission to enter in the case of an emergency or other tenants complaining so its worth a look.
If you do not have a lease, you basically are a guest in their home and your rights are very limited. If you do not already have one I would look into getting one made so that you protect yourself from any legal action down the road.
