Landlord Issues!!!!!!!!!?
Our Landlord comes round all the time to check up on us - thinks were ruining the place but the letting agent thinks our house is neat and tidy.

Its getting a bit annoying having him come round all time (we get notice in writing).

Its in contract that he can come round once every 3 months for regular check and any other time "with good reason" - his reason is he thinks were not looking after property.

Letting agent is siding with landlord even though they think he is being a prick.

Is there anything we can do?

If he is giving you written notice, and you signed a contract agreeing to his coming around, it is legal and you are stuck with it. Your only option is too give notice and move.

Stalking mentioned above, requires more than just coming around checking on the property. It requires a sexual or emotional interest in you. Unless he has brought you flowers and sent love notes, you will probably get cited for false police report for alleging stalking.

Harrassment won't apply either since you signed a contract agreeing to the visits, and the LL is acting within his legal rights under the law.

Your contract may have something but you'd have to go through it with a fine-tooth comb- what does he consider "good reason"? Is there anything in the contract protecting your right to privacy or your right to not be nuisanced? Perhaps you could talk to him and come to some arrangement- offer to send photos perhaps. Remind him he's holding a security deposit so you have an incentive to keep the place in good condition. Or every time he comes just follow him around with the vacuum cleaner maybe, if you're feeling passive agressive. like, make loud noise, or eat garlic then stand annoyingly close to him or something.

The Landlord has no absolute right to intrude into your property His only rights to enter during tenancy are:
a. when Tenant agrees
b. under s.11(6) of the Landlord and Tenant Act 1985 [24hrs. written notice asking for T for daytime access so L can inspect installations which he is responsible for repairing.

Certainly Landlord cannot just turn up at the property and expect to be let in, or even let himself in. This is not only trespass (civil wrong) but also harassment (criminal offence).
• In a true emergency (boiler suspected not working is NOT an emergency).
• If the tenant permits access.
• If a court orders access.
Write a letter to your agent and landlord, stating, you are aware that in the agreement there is a clause that the agent will do a property visit every 3 months, which you happy with, and you are more than happy with the landlord attending these visits.
You believe that the agent has found no problems during these times; therefore you find the extra checks by the agent unnecessary. You would therefore ask that, in future the checks are limited to once in every 3 months, for both agent and Landlord.
You can state the Landlord tenant act if you like. Basically if you say no, there is nothing they can do, as if the enter without your permission they are trespassing.

Unfortunately, the letting agent is going to side with the Landlord, he pays them a fee after all, don't thin there is much you can do there apart from chatting with them and getting them to keep reassuring the LandLord. Also, try and talk with the Landlord yourself. Explain the situation and that you (and whoever is is living there) are responsible, clean and tidy and that you feel he doesn't need to come round so often. Its all about the tactical approach.
But, if you really don't like it, move out...plenty other houses/flats out there that'll do you a good price the this climate, with a nice landlord too!

Well i mean if u have the place nice and tidy and the rent is due on time he shouldnt be up ur *** so much. id move out cuz i just dont have the paciense to deal with people like your landlord.

There is something called a Covenent of quiet and enjoyment which means you are allowed to use the premises without interfearence. The contract says once every three months - which is a bit excessive but just about allowable. Coming round at other times without good reasons ie, emergency or to do repairs is against the covenent. He has put 'with good reason' in the contract but unless it is for emergencies, this is not actually a legal statement and cannot be enforced. I would be tempted to change the locks - naughty but if he questions it, have a set of keys ready and say your bag got stolen with your keys and address in so you had to change the locks.

If he comes in whilst you are out, then it is a big no no. As well as being against the Covenent, he is leaving himself open to trouble. My landlord did the same so I 'invented' a sum of money which I had left on the side in the house and which had disapeared. I said that no one but him had been in the house and that if the money did not show up I would have to get the police involved - I had proof that he'd been in the house without permission and on his own. I let him stew for a couple of days and then 'found' the money in a book! He hasn't let himself in since! Naughty, but it got the message across.

If this is really annoying you, get in touch with the council's private tenant department and let them have a look through your contract and discuss with you what 'reasonable access' is!

If he is giving proper notice he's within his legal right but keep track of when he comes around and the reasons. If it's excessively just to check in and without material purpose, it could be ground for a harassment case.

I don't think there is much you can do if it's in the contract and he's following the rules (i.e. presenting a written notice in advance).

Just try to get him to understand that you think it's infringing your privacy and that unless he visits less frequently you will leave the place. After all, the deposit should cover any mess you might make.

You should talk to a lawyer or even the police. Make sure you have to lease agreement with you. That is along the terms of stalking... they should be able to restrict him from popping up whenever he feels like it.

If I feel the need I do inspection visits every month for the first 6 months of a lease with new tenants. Nobody minds as they realise it is in their interests as much as mine.

Never change the locks without permission as you could end up in a lot of trouble and to be honest 'dreaming up a sum of money which has gone missing etc' well that could be classed as threatening behaviour.

I do not understand why people do not appreciate that a landlord owns the property the tenant only rents it.

When I rented last year my landlord visited almost every week to check the garden etc I didnt mind why should I? A few minutes of my time to reassure the owner of the house seems fair to me.
