Tom X | Landlord Stealing our Electricity? |
We live in an apartment complete with about 8 units. For the past several months they have been doing a lot of renovations in the basement. Just today our air conditional tripped the breaker to our unit. Our breaker box and meter are located in a separate room in the basement that is kept locked to the tenants.
We called out public service company (who have keys to the room) and we were both shocked to see that someone had hacked into the breaker box and installed an electrical outlet. He assured us that anything that was plugged into that outlet was being charged to our bill. The room had a bunch of sandin equipmentnt, high powered lights and easy access to all the other rooms in the basement.
Can anyone advise us on what to do next. We have no idea how long this has been going on for and how much electricity they have used. We took pictures and the public service guy said he would document this in his report. The amount of electricity they used might be negligible but just the fact that they would do this to one of their tenants really makes us feel used. |

Hey Tom sounds like you are hosed. Either pay it and don't complain, or complain and plan on moving. I don't know that I would trust the landlord after that. |

Go file a complaint with your local police and/or district attorney. Also, you are not responsible for any of the electricity that might have been stolen. The utility company can determine how long this has been happening and how much has been stolen by looking at the previous history of the account. You should be able to tell by the increase in your usage from prior months. Ask the Electric company for a 12 month printout. Otherwise use inform the landlord 1k will prevent you from filing Theft of Service Charges. |

There are 2 issues here, the first being that your breakers are located in an area where you can't access them. Suppose there was a problem in the apartment - and I mean serious, like you being electrocuted (it can happen where the breakers won't trip), whoever else is in can not turn the power off to save your life. There are other reasons for me to be concerned about this situation where you can't turn the power off, apart from anything, calling out the public service company each time a breaker trips will cost you money for the call out (lights blowing can cause a trip as well - nothing serious but still have to get the guy out). I would ask if the landlord can give you access to the circuit breakers for safety reasons.
Now for the socket in your electricity supply, that is a bit weird again. Now back to the safety aspect, this was either put in when the power was off - maybe before you were a tenant and he could install it safely, or it has been added recently while the electricity supply was still live - again a very dubious practice. Since this is part of your electricity supply you can ask the landlord for a safety certificate for the electrics - it is your life at risk if this causes a fire due to poor installation ("hacked into" suggests a bad installation).
Now if the socket has been there for a while it might be difficult to prove if it has been used, however if it is a recent addition then you might be able to notice an increase in the electricity you have used when you compare it with the previous month and the same month the year before, hard to tell though. One thing you could do if you get access to the room is an old trick but to glue a hair across the holes in the socket - if the hair vanishes then someone has used the socket!
My next step would be to ask the landlord if he has been using the socket, and also check your tenancy agreement to see if it says he can use the power down there |
