My landlord came over the 30th, she started out by saying she was there to collect the rent, I told her we didn't have it which she already knew cuz my husband is not working due to an injury on the job and we are fighting with his company to find out when he will be getting paid. She knew all of this before she came over, and I told her and she tried turning it around saying she was told she was goin to get the money. She asked what we were goin to do since we didn’t have rent, which rent wasn’t due until the 1st with a 5 day grace period, I said well if your goin to change your mind then we will be moving out, So then she flipped out and said she wanted us out that night, and she has a key and would be back the next day with her husband. I said ok and started to close the front door. She then put her foot in the way of the door closing and forced her way into the house. I asked her to leave several times and told her I would be callin the cops if she didn’t. She refused. She finally left and said we had until the end of the weekend to be out. I then called the police to make sure it was documented just in case they came back. She then called later that same nite apologizing for what she had done and we had an agreement that I would call her on the 5th cuz we had planned on talking to someone on the 4th to try to find out when my husband would start getting paid. She said ok well call me the 5th. As of that I thought everything was ok. Today –Monday- this lady comes over tryin to serve us with eviction papers, which weren’t even legal, and she asked for our garage door opener. We said no, and gave her what she needed of the papers back and said we weren’t signing them cuz they didn’t even go through a legal process. On there “eviction notice” they are saying we owe them $ 1550.00, They are saying as of October 1st. The 1000.00 from that is Decembers rent, and 50.00 is from a check that we stopped payment on after my husband basically lost his job, cuz we didn’t have that money, which we told them prior to tryin to cash the check, and they did it anyway, and then told us it was goin to go through another time. then the 500.00 was the rest of the deposit which was what the check was written for, but that was also agreed that we would only have to pay at least 100.00 along with rent to complete the deposit amount. Of course they said they had no idea about that as well. I guess my question Is, since she came into the house without my permission then failed to leave when repeatedly asked to, is that her going against the lease agreement, and how long does it take for the whole eviction process to go through? We plan on moving out anyway, because these landlords change their minds along with the weather and I just can’t handle now things coming out. To me it’s a way for them to get money because they can’t seem to sell the house we are renting and they already bought another house. So they have 2 mortgages, 2 kids, other bills. Which is completely understandable if they need the help, but they seem to be taking advantage of the situation, telling us we can to one thing, and then when something goes wrong they change there minds. Please help. And I will take any other information you can give as well Additional Details Im not 3 days late, i said there is a 5 day grace period, meaning i have til the 5th of the month, and im sure she doesn't have the right to come into the house when she hears something she doesn't like, especially after telling her to leave. She was over on the 30th asking for money, which in the lease she doesn't legally have rights to til the 1st, and she has to give us notice first to give us a chance to pay or fix whatever was wrong, which there was nothing, and like i said the eviction wasn't even legally done. |

It is clear that your landlord does not know the rules that must be followed by a landlord even when the tenant loses a job and cannot pay the rent.
I recommend that you begin looking for a new place to rent immediately.
Part of a landlord's job is knowing what rules to follow when a tenant cannot pay the rent and be willing to follow those rules.
The only real solution for you is to get a new landlord immediately. |

Your story is way too long and much of the information that you have given has NOTHING to do with not paying rent.
1. The landlord doesn't care if your husband lost his job or not. YOU can get a job or he can find something else...people in wheelchairs work at Wal-mart.
2. If you are behind, the landlord has to go through the court to give you proper notice for an eviction.
3. It doesn't matter why they need the money...that is absolutely none of your business....YOUR JOB is to pay the rent when it's due, or not expect to stay there.
4. I would HIGHLY recommend you get IN WRITING either a legal eviction notice or something in writing stating that you were evicted...or else she can hold you to the remainder of the lease if you just bolt.
5. I would also HIGHLY encourage you to work it out with the landlord and not cut your nose off to spite your face...where else are you going to rent when you have just been evicted and neither one of you have a job? NO PLACE!
6. They have the right to cash any check you write to them and charge you any fees...a check is a legal promisory note...and you CANNOT legally cancel a check unless fraud is involved...otherwise, you have just committed a misdemeanor. |

Regardless of the circumstances, what the landlord did, what you've done, what hasn't been done.
You have to follow your LEASE that you signed. That's the law. Re-read it until you know it like the back of your hand, its the only thing that will hold up in court. When you get to eviction court and you have an attorney, its the only defense is what the lease says 95% of the time. |

First of all, whatever their financial problems are - not your business - and this reflects the deeper problem - this got personal instead of professional. Here are the facts:
Depending on your jurisdiction and specific contract, she may evict you for non-payment of rent with less than 30 days notice. I think standard is ten days. You also have no right to live her in her property without paying. That your husband got hurt on the job, that's a shame, really - not her problem. You breached the contract by not having the rent - which you don't dispute - when it was due.
Fault on her side is that she needed to take it back from a personal issue. She may be feeling financial pressure but that's not your business and she shouldn't visit that frustration on you. Here's your remedy - contact your local landlord/tenant court to find out your rights in your area. You WILL no matter what, have to pay for the time you're there but you'll have a time frame as to when you have to out. Sounds like you'd be better off moving to a corporatly owned apartment structure. The downside for you, they're like the bank - they're not gonna care what your problems are as long as you pay them your rent and on time but they won't be harassing you or sticking their foot in your door.
Note to the edit - were you going to have the money within two days? A grace period is not additional time to pay. You rent is STILL due at the start of the grace period - what it means is that you simply won't incur a late fee if you pay it within that time. |

You need to talk to someone at the courthouse. It really depends on where you live. Usually, it takes a few months to really evict someone. She will have to go through the court process and if it is cold outside and if you have children or medical issues, it may take them longer to get you out. I would try to pay whatever rent you can and ALWAYS pay by check. NEVER by cash! You can NOT prove that you gave her cash. Find out what the laws are in your county, city and make sure that you know your rights. Unfortunately, you can not withhold rent because she broke the lease. If you are physically living there, you owe the rent. No way around that. You may also want to see if there are any agencies in your community that might help you out with the rent until your situation gets better. I don't think that she can come into the property without your permission. I would not signed anything from her. Wait until the sherriff's office serves you with eveiction notice. Do not accept one from her. Good luck! |

You are, of course, legally obliged to pay the rent when due in order to enjoy the benefits of the lease. The first question is: are you able to pay the rent, even if a bit late? If so, it's a win-win situation to arrange with the owner to do so. If not, you need to make other arrangements as quickly as possible. You say that the papers which were served on you were not legal; how do you know this? If they were in fact legal, and you don't deal with them appropriately, you could be evicted -- and eviction on a record is SERIOUSLY bad. |

what does the fine print on your lease say? what does your state say about it. you need to do some research. you are technically in the wrong since you owe her money. and whatever you signed is what the agreement is no matter what you guys talked about or agreed upon after. i honestly think you are in the wrong. the landlord can come in your house, and evict you under terms they feel are right. but it all depends on your state. i know it is hard to believe you did anything wrong, since your husband is hurt, but you need to look up and see if you have any rights. research research research. |

As a renter .. if you don't pay the rent and they evict you , most times with an eviction you have 30 days ... sometimes they can push it to less...
The lady that you rent from does have the right to come onto HER property... its just like having an apartment.. the landlord has the right... for them evicting you , you will lose your deposit..
I have been in rentals before, and many times they can come in with a bee in their bonnet and bust you for anything and kick you out.

Too much information that doesn't help. How long have you been renting and what are the terms of your lease for deposit and monthly rent ? I can't tell what's really going on. It would look like if you move out before the 5th of December, you wouldn't owe December rent or at least it should be prorated. Their coming up with an eviction notice pretty much lets you out of the lease. You do owe the agree upon rent for the time you have lived there and the deposit as well. It usually is up to the landlord as to whether the state of the house meets the requirement for return of deposit. |

As far as I am aware, and please check your local statutes, a landlord is required to give you 30 days notice before throwing you out. You should also check your lease and see if it gives limitations or standards of conduct that need to be followed between the lessor/lessee. |
