Landlord and no deposit ?

He has 30 days after you move out to give you a detailed account of funds, 21 in CA.

After that time passes ask again, let us know what he did.

Attorneys are not allowed in small claims court anyway, you can handle this yourself.

You have no choice but to take him to small claims, if you dont then you better make sure he gives you back your money, You gotta keep your pics and all proof if you take him to small claims, and do it now.. Before its too late.

You have to take it to the court regardless. Don't think that this will make you look bad, your landlord is too busy being an @sshole by not giving your well-deserved money back and keeping up his part of the bargain. If he's playing dirty slap him back in his place.

You need to ask him in writing the reason why. If he refuses to say, then get a lawyer.

If the deposit is a limited amount (which I'm sure it is) you can go file in small claims court. You can represent yourself and they paperwork is easy to fill out. Make sure that you file suit against the owner of the house- NOT the management company (that is a technicality they can get out of). If you do not know for sure who owns the house, it is public record. Look up public documents in your county online and type in your address and it will show the name on the tax records.

legally he has 30 days to refund all or part of your deposit If he does not, he needs to inform you in writing why he is with holding the full amount or partial amount. If you feel that he is in the wrong, you can take him to small claims court and sue for your deposit, plus court costs. (you don't need an attorney for small claims court)

In most states the landlord has 30-45 days to return a deposit. If they are not returning it they must submit a written statement of charges against your deposit. You can make a written request, stating that you know your rights under state law. If they do not respond within the time frame you may be able to sue them for triple damages in small claims court (no attorneys and inexpensive to file the suit).

Send him a certified letter with return receipt asking your deposit back and give him 15 days (reasonable time) to comply. If he doesn't comply, take him to a small claims court. Attorneys are too expensive and could eat up all of your deposit plus more, for this type of problem.
Since you have pictures and a copy of certified letter, you should not have any problem in the court to get judgment to your favor. When sueing at small claims court, add to the deposit amount, the time and costs of having to take him to the court plus a reasonable interest rate on the deposit. Your ex-landlord will end up paying more than what he originally owed, a good lesson for being dishonest.

When you move out most of the time you are required to do the following:
1. Give Proper Notice
2. Clean everything including inside of oven, windows and tracks and tub and complete bathroom
3. Clean and steam carpets
4. Patch any holes in walls

5. Landlord is required to give you a break down of all charges they are claiming within 10 days of move out.

6. They are also required to give you back simple accrued interest so he needs to show you charges and credit and balance.

That is required by LAW.

The best thing you can do is talk to him. Was there any damage done do the house while you were there??? If not, he should give the deposit back. You're only choice is to involve lawyers, or take it into your own hands, "wink wink"
