hi - our landlord recently informed us in letter that he intends to put rent up. weve been renting for almost a year (it was february last year we moved in)
we never signed a contract with him, we signed one with the letting agent who closed. after that we took it as a verbal month to month contract with him. we want to move from the property anyway but its too soon. he says he will reduce the days to leave to 10 days instead of 30, but we cant move there is nothing at the moment (in the way of other properties)
he wants to know whether we are in agreement with it
we are not as we think its too much money for the house, its got an old kitchen, cupboard doors hanging off, an old fridge.
we were with a letting agent but they shut up office (they were dodgy) he has our deposit. do we say :-
1. yes we are in agreement & agree 2pay if for another few months til we find something else or
2. say no were not in agreement
but then he will say well ull have to leave. plz help me Additional Details thanx everyone i just hope something comes up! |

good question.. You can do 2 things, agree and pay the rent. Or.. not agree and don't pay the rent. He will then evict you. He HAS to give you 30 days to get out after he submits an enviction in written form. So if he just comes over to evict you it doenst mean squat! but if puts it in a letter then he has to give you 30 days.. then.. if you still dont leave he then will have to go to court to get you out and they will send you eviction notices and give you another 30 days to get out. So essentially you will have 60 days to get out. plus, look up laws in your state, there probably is a law that says he has to give you more notice for making your rent higher. It is most likely something like 60 or 90 days. he CANNOT kick you out in 10 or even really 30. |

I think you should start looking now and just agree to the raising of the rent, so long as the landlord is willing to leave you on a month to month rental basis. It's the simplest solution.

Since you are not tied to a lease, the landlord could impose any amount he wishes. I suggest you start looking for a new apartment if you don't agree with the new rent. The sooner you get out, the better for you. After all, you weren't really planning on staying. You had better pay the new asking price if you don't wish to be thrown out onto the streets. I don't think it will take you more than two months to look for a new place so you'd only have to pay the new rent for a month or two. |

I would not agree to move out in 10 days instead of 30. You could end up moving into a property just because you run out of time.
You need to see the Citizen's Advice Bureau - they provide free legal advice.
In the meantime make sure that you have everything in writing from the landlord. Instead of phone calls write e-mails or texts, because somehow you need to prove what he has said to you.. |

I would guess the agreement you signed with the letting agent is still valid. Agents like that are acting on behalf of the landlord... it's the same as if you had signed in front of the landlord. In that case your could hold the landlord to whatever terms are in that rental contract. If you have a copy show it to the landlord.
If not your verbal agreement is worth the paper it was not printed on. The landlord can do what he wants. You either pay or move. |

You can legally sign up to give only one months notice to quit, but get advice from Citizens Advice (they are free) first. Then approach your landlord.

The answer just came out of your mouth, sunshine. You've stated that you cannot move right now (nothing available), yet the LL wants to raise your rent. Since you have no other choice, accept the higher rent WITH the "10-day vacate" policy....get this ALL in writing. Then, keep a watchful eye for a new place. Once you've found one, give your LL your 10-day notice and you're on your way. |

Either pay to stay or move out when he wants you to. There's no alternative - paying up will give you time to look for something else more suitable. Sounds as though you will be well rid of such a dodgy property anyway, so it will eventually work to your benefit. Dont add to the stress of moving if you can manage to pay. Have you tried to speak with him and offering slightly less than he's asking..... he'll have problems finding another tenant probably, if the place is as you say, so if you dont ask, you dont get. You got nothing to lose and it could save you a few bob. |
