My lease was up on December 1st 2007. I asked my landlord in November if we could stay until March 1st and I had received a certified letter today on January 15th. The letter was dated on December 31st and it says I have until February 1st to get out. That is only 2 weeks away. Doesn't he have to give me 30 days from when I pick the certified letter? Also, as long as their are no damages to the place, which their isn't. He has to give me my full security deposit back within 30 days right? What are my rights and how should I go about this? |

As others have stated, if the postmark is Dec 31 or before just because you didn't pick it up doesn't give you extra time, the landlord has met his burden. And I am betting since the letter was sent certified mail, the landlord knows what he is doing and it was sent by Dec 31.
As to your security deposit, the rules vary by state. In my state (IL), the landlord has to send the tenant a letter within 30 days detailing any charges being withheld from the security deposit and return the remaining balance of the security deposit within 45 days. |

You didn't say whether it was fine by your landlord or not. And no he does not HAVE to give you 30 days. Sounds to me like an eviction-can you afford it? Not just money-wise but credit -wise.You should have resigned a partial-temporary lease for the extra months you wanted. I was in the rental business for 13 years and if we had a tenant that wanted to stay on we were glad to have them. You must not be a very ideal tentant. Sorry. |

What's the postmark on the envelope say? If it's before the end of December, the landlord has met the legal requirement. People often let certified mail sit, or don't claim it altogether, thinking it will let the clock run longer or let them say they were never notified, but that argument doesn't work in court. |

In a lot of states once a lease agreement has expired you go on a month to month, if no new lease is signed. You may have asked if you could stay till March but he does not have to agree. It sounds like he has given you a notice and you need to move. |

T-H-E-R-E. THERE are no damages............
If you didn't pick up the certified letter in a timely fashion - that isn't his responsibility. He gave you the proper 30 days notice if the postmark is Dec 31.
Just go out and find a new place to live. Talk to the landlord again as well. Maybe you can work something out. But if he sent you that letter - chances are that he already has someone to take your place.
Also - did you get it in writing to stay until March 1? |

First off, if you were extending your lease, you should have it in writing. It's going to be hard to prove your case if you don't. Tenant laws vary state by state, so I'd recommend a google search for landlord/tenant law in your state. I don't think that the landlord has to wait for you to pick up the certified letter...I think it's based on date sent (how would they be able to show when you picked it up?)
As for your security deposit, read your original contract, as well as anything it says about lease extension. It should be outlined in there as to when / if they have to return your deposit. |

Well since your lease expired and it seems that the only thing you have is a verbal agreement to extend your lease to March, that isn't going to help much, because that means that your stay at the apartment has transferred to a month to month lease, and what this means is that at any time during that month yourself or your landlord can terminate the month to month lease because there is nothing in writing to avoid the termination and therefore only has to give you a three day notice to vacate, however, you have to figure out why he is asking you to vacate before you can determine if there is anythign that you can do about it, my guess is going to be no the first and foremost thing to remember when dealing with contracts is verbal agreements are not valid, and cannot be forced to be held up, if there are no damages to the apartments and no fees owed then yes you are entitled to a full security deposit refund. |

You need to have been given 30 days notice. Which he has appeared to have done with the letter dated 12/31.
HOWEVER, just because a letter is dated 12/31 doesn't mean that it was mailed then.
Since it is certified, look at the postmark. If it's after 12/31, then you have until March 31 to leave. If it's 12/31 then you need to be out by feb 1.

I would call your landlord and explain that you just received the letter today and your not sure if it got messed up in the mail or not but since it's only two weeks before February 1st you don't have anywhere lined up to move and see if he'll let you stay a little longer. |
