Landlord legal question?
I moved out of my old apartment. I gave the landlord $1200 for security deposit. We walked through the apartment on my move out date & she said nothing about the condition of the apartment, because she coulden't. I actually made the place nicer than what it was originally. I just rec'd $300 & some change back from her from the security deposit. I plan on taking her to court becuase there were no damages what so ever to the apartment. Her reasoning for why I did not get all my $$ back is because she trying to charge me now for my boyfriend who I let stay over once in a while. She wrote "reasonable guest fee to cover extra expenses is only fair because there is no free lunch!" I never signed anyhting saying I was willing to pay a guest fee. She also wrote the guest fee isn't rent & it can be specified in any lease contract to state how much will be charged per day/week but my lease doesn't mention any daily/wkly fee. She is being unfair & charging a guest fee of $900 for less than 1 yr

Okay, if you did let him stay over every so often you are probabley ok, but if he had moved in or stayed for weeks at the time she may have a point. But I think if you take her to small claims court you will win, I am a land lord myself and most Judges seem to dilike us even if we are right. But in this case she seems to be unfair, also keep what she wrote so you can show the Judge what type of person she is. Good luck

More of a rant than a question.

However, your point is valid. I would approach her for the full refund, then go to court if needed. Make sure you also ask for court costs and legal fees.

You have a case. Regardless of whether or not a guest fee is supported by your states landlord/tenant statutes, if it was not in the contract, it is not enforceable. Anything not backed up by your states landlord/tenant statutes is unenforceable, as is anything she neglected to include.

you can't be serious!
She would have had civil court papers slapped on her before the close of business THAT DAY!

there is a small fee for doing so and ask for her to have to pay that back to...after you file your court papers, call all the tv talk shows (the people's court, judge judy etc) they would love this one and in addition to getting yoru money, you get to make her look like an azzhole on national tv!
your ex landlord sounds like a real piece of work!

If it was not a part of your lease, she cannot charge you. Take her to court for your money.

That is absurb and ANY judge will agree. There is nothing she can legally do to prevent or charge you for a guest in your apartment. It would be differant if you rented a room, split bills and you moved the guy in. But, from what you said your guest had no impact on her apartment or her expenses as the landlord.

I would add on "emotional stress" too, as you are being forced to discuss your very private life in a court room and find it "an invasion of privacy". You will win that too (well, in CA you would), as she is the one that took a rental agreement and brought your private life into the matter.

Try to look mortified that you have to mention that your boyfriend spent the night. She has stepped over the line of the tenant/landlord relationship and needs to know when to mind her own business!

i would take her to court make sure you have a copie of the contract that you both signed

You should not have a problem getting your money back as long as there is not a mention about the guest fee in your lease that you signed. Bring this to her attention and try to settle it the easy face to face way before you go dragging this into court. Court might be the ultimate solution ,but if you can settle it out of court it is much easier.

she cant do that....go to the book store and buy a book called Tenants Rights, for your state. step by step, easy to understand language. you'll be able to put her **** in a ringer.
