BATS17 | Landlord locked me out and put all possesions by the garage In state of CA? |
Can the police force him/her to let me in to sleep there/stay there?or I just need to sue? It looks like all belongings are there. Based on what I have been researching I need to bring it as a civil case suit. I have not paid for 3 months rent, verbally and texted landlord agreeing that I would move and then I was given 3 day notice to quit. What should I sue for? Additional Details Just to add, Im not on the lease I was staying over as guest, I was given a 30 day notice before the 3 day notice was given, so then landlord chaged locks and put possesions by garage to be picked up asap. Do I call police/sherriffs? |

Don't Sue because you are in the wrong. You haven't paid for 3 months. Please learn to pay your bills. Do you believe that you are entitled to a free place to live? Please pay your bills. |

Check your lease agreement.
It is likely that your landlord is fully in the right in evicting you and that you have no legal recourse. A verbal/text agreement won't hold up if the lease agreement says he can do it. Contracts trump verbal word.
Stop talking about suing. You didn't pay your rent for three months, you are a deadbeat tennant and the landlord shouldn't and won't be punished by the law.
Pay your rent next time and own up to your financial responsibilities.
Good luck! |

Don't waste the time of the tax payer funded court system. You don't live there any longer due to non-payment of rent. Take your stuff and go. Perhaps the landlord could sue you for storage fees. |

pay your rent in the future and it wont happen again |

Well you can't just live for free! The rest of us don't get to do that. I suggest you start looking for another place to live and be more responsible about paying for the roof over your head.
The landlord needs to live and support him/herself as well and if he/she let all tenants live for free, where would that leave him/her?
Think about it and good luck to you! |

1st you are not a tenant you said you were a guest (so no lease) sounds like you are trespassing. 2nd no one has paid rent in 3 months, what happened to the tenant who you were staying with? Kick out for not paying rent. You have no rights and no free lunch. What would you sue for? Free rent at a place you were never a tenant? You are lucky he does not sue you for past rent. |

You can try to call the police...but what are you going to show them to prove that you actually lived there? Besides...in cases such as this...the police usually don't get involved citing that it's a civil matter.
What could you possibly sue for? What are your damages? As I see it you got off easy by having a place to live for three months for free. You screwed the landlord and got away with it...move on. |

If my tenants don't pay my rent within 10 days of due date they are getting locked out. Pay your bills. You are not entitled to live there for free you lazy bum. |

You haven't paid rent in 3 months and are just getting a 3 day pay or quit? By law, the landlord can't lock you out until after they have received a unlawful detainer judgment from the court. Then the sheriff will meet the owner or landlord at the property and the locks can be changed. After that, the owner has to hold the belongings (over $300) for 14 days. You can get these items after you have paid any storage fees. If the owner hasn't done these things, you can take him to court, but he can counter sue you for any damages, etc.
I would make sure that there wasn't a summary judgment against you before you go forward with a law suit. |

You have no lease and no legal basis to be at the property.
Go pick up your stuff. |
|

Trouble
|
If you have been evicted through the court, too bad, so sad.
If you have not been evicted through the courts, the landlord cannot lock you out. The police will make the landlord give you entry. |
