Landlord not reporting rent as income?
After doing some research, I've come to find out that my landlord has no permit for the basement apartment I'm living in. On top of that, we've got double the amount of people living down here than is legal for an accessory dwelling in the state of Virginia.

I'm now almost positive that she's not reporting the rent she's getting as income, and it's no small sum. As a conservative estimate, she's getting at LEAST 30K per year if she has all the rooms rented out at the same rate, which, I'm pretty sure she's not, as one of the rooms she's renting has access to the rest of the house, which means they're probably paying more for access to the stove, the washer/dryer, and other amenities that we don't have down where we live.

Now, my lease is up, and I'm paying month to month. I'm pretty sure I could just leave without saying anything, and get away scot free, but I need to know what I'm SUPPOSED to do.

report it to the IRS...let them figure it out. i see a lot of MYOB..but this is tax fraud...which all USA citizens pay for...it's also State tax fraud which we all pay for. This is no different than the creeps that sell food stamps or cheat the state medical care. Why should 1 person have added tax free income at the tax payer expense? This is a crime...do your duty as a citizen.

Just leave. Why stick your nose into someone else's business when she's done nothing to wrong you.

Ask yourself this: Did you enjoy living there? Did it serve its purpose? Did you feel you got a good deal, or at least didn't overpay? If you answer yes to any of those, I'd just leave and move on to the next thing.

u can just leave. u know miss about a month of rent just keep postponing it . save your money and get out. but what she is doing is definitely illegal. she can get a $10,000 - $50,000 fine plus another fire hazard fine. she'll end up foreclosing her house. about a year ago i extorted my ex landlord for renting me an illegal basement while i had a baby and to many people with me. he gave me $2,000 plus my $1,000 months security with 2 months free to save my money to get out lol. he would of gave a grand for leaving early but i took the 2 months

Month to month you can leave with a 10 day notice so line up your next place and give a notice. Why do you want to make trouble for your landlord? Do you really want to get involved in a mess like that? Hope your own nose is squeaky clean.

If your paying month to month you can leave when you please. Chances is you wont get your security deposit in less you give notice. If there illegal apartments, then she is most certainly not paying taxes on the money you pay. That's clear cut cash in her pocket. If you don't like the place or agree with the landlord, dip out.

I don't know what laws apply in Virginia. If you are month to month tenancy, then you only have to give written (and you keep a copy) notice that you will be vacating in 30 days. But check local laws. What you do about your landlord is your business but your actions reflect on your character. You do what is required by law and your conscience is clear. If you feel the need to report her, then do so but to the permit people. If you want to get even about the rent, send her a 1099 for your rent. Anyone can do that and the IRS will see if she's reporting that income or not. But be sure you follow all the rules and send your copies in too or the IRS will come get you.

Give her whatever notice is specified in the rental agreement. You may need a reference from her to get another place. Often there are ordinances that make it difficult for people to get the necessary permits to rent out their property. You decided to rent from her for a reason. (maybe the price, maybe no credit check) I say, do the right thing. That's always the best course of action.

Start with City Hall, see what they say, but don't say anything to her about what you found. If you are wrong, that could get ugly. but they'll have to do an investigation, because if the building has too many peoople, that's not safe. You should let her know you're leaving, but make sure this gets checked out first, you don't want your credit ruined.

Unless you're a tax collector or zoning official, I'm not sure you're SUPPOSE to do anything. Nothing you've said seems to have harmed you. I suppose if want to be a jerk, you could report your landlord to the authorities.

Ah, evil people avoiding the IRS. It's illegal alright, unless of course if you are paying cash every time under an amount of 1000 per year, which i now see your not. So, you should probably leave and not say anything because if shes caught and you knew you would have some kind of legal action taken on you. But yes, she is cheating the system, and she might or might not get caught. If you really hate her, report her...

Alot of people do this, earn income 'under the table'. If you put down a security deposit and plan on leaving, don't pay the last month rent. And then just move out. She won't come after you and your defense will be that you left your security deposit behind as your last months rent. But if she is breaking the law, she isn't going to come after you legally because she would be turning herself in.
