I am really un sure what to do about this!!
I moved into my rented rent at the end of February 2008, a month later I got a letter through the door from a solicitors saying that we need to find different accommodation as the mortgage company are going for proceedings to reprocess the flat from the landlord.
I contacted the landlord whom of which I get on well with and speak to as a friend, he informed me that he was having some troubles but it will get sorted, I have since then had another letter saying that repression will take place on the 1/4/2008 and bailiffs will be knocking to change the locks ect on that date.
I have told him about this and he has said that he needs to pay them off by the 1st to stop this happening, he said he needs my rent which is due on the 30th to help towards the payment, and however I am worried about handing him anymore money.
What should I do?? |

If you have a tenancy you have protection through housing law. They cannot just kick you out if they have taken possession, nor can they enter the premises you occupy and change the locks and keep you out. They can change the locks to keep the previous owner out but have to give you a new set of keys.
If it has been repossessed it will have a new owner (usually the mortgage company) and it is they who are or will become your Landlord. They then have to issue the correct (ie two months in writing) to terminate your tenancy, or keep you as a tenant. In my opinion pay your rent to protect your position but ask the solicitor who wrote to you who to pay it to, and get a receipt. |

Your tenancy is protected by law. Regardless of the landlords situation you cannot be removed from the house, neither can bailiffs change the locks without either a court order or your express permission. I suggest that you contact the solicitor that has wrote to you and tell them about your tenancy. As for your landlord, pay him by cheque on the 30th. That way you have protected your position with the option of cancelling the cheque. Do not allow the bailiffs into the house, because this is a domestic premises they are not allowed to enter without your permission. |

Wasn't 1/4/08 almost a month ago? Believe the legal papers you have been served, not the landlord, he has already lied to the mortgage company (promised them he would pay, he did not) so why would you put your trust in him? You need to move or you will find your belongings on the street. I would also be worried about giving him more money -- what has he done with the rent you have been paying? |

You poor thing.. I can totally understand how worried you are..
However... if you pay him.. you have no assurance that the house won't be repossed.
Something that did strike me though if you are in the UK.. I would presume you had a shorthold tenancy.. which means you cannot be evicted without a court order for eviction (You are not the homeowner so won't be listed for eviction under the repossesion order)
If I was you, I would not pay him another penny but seek some legal advice first on what your rights are and be prepaired to have to move out on this date if needs be.
The key is.. You will need better advice than Yahoo answers I am afraid.

Everyone is right, you need to get out. You don't need this sort of stress. Get down to your local council and get the number and address of a good housing advice centre. They can give you the correct advice regarding your situation - but do it TODAY!
Bailiffs cannot just come in and chuck you out. They have to have the correct paper work. The advice centre will make sure that they do not try to evict you illegally. |

Start looking for a new place to rent and get the hell out of that one asap. When things have got to this stage, there is no coming back like your landlord thinks. Get out before its too late, as you can't say you weren't warned. |
