Landlord refuse to give me the mailbox key, is that legal?
Rcently rent an apartment, its owned privately, landlord doesnt live in here and drops by sometimes a week. She refused to give me the key to the mailbox, only promised to pick up my mails twice a week, because she has her own private mails mailed to the same mailbox. Without access to the mail box, I lost two packages few weeks ago, since the landlord was out of town without notifying me and didnt pick up any mails.
Anybody knows if this is illegal? In the future if the same problem still exists, is there any legal association or places that I can go and complain with?

You need to go talk to the post office, she does not have any right to see your mail before you do. They will either give you another box at that residence or one at the post office. Something is going on if she does not live at that address but gets her mail there. Go talk to the post master.

I'd check with the post office about the regulations. You can rent a post office box to get your mail. This is a very peculiar situation. I've never heard of such an odd thing. She is getting mail at your residence. I wonder why.

state law provides that you have unfettered access to your mail...and that the landlord provides an acceptable mailbox.....

You have to notify her in writing that she has violated state law....just google your state & landlord/tenant laws....and that she have five business days to provide you with a private mailbox.....

She probably has her mail there to fool the IRS that she resides there in the hope of avoiding capital gains tax down the road when she sells....fraud fraud fraud....but is neither here nor there for you....

In the meantime.....go to the post office and hold your own mail until resolved....inconvenient...but safe...

If the landlord doesn't comply....you can easily go to your small claims court and ask for an emergency hearing....Judges love to thump landlords on the nose when they violate the rules....don't let it intimidate you....any costs... will be reimbursed to you by the landlord per the judges order

After thought.......you may need to talk to someone at the post office about mail tampering.....they take it very seriously and prohibiting someone from access to their properly addressed mail....could be a criminal offense.

I don't know the legality of the issue as I am not a lawyer, but you can simply take your lease/rental agreement to the post office and have them change the lock. Then your landlord can either pick up her mail from you or she can have it forwarded elsewhere.

She is probably using your mailbox for personal gain, such as to show the unit is owner occupied so that she can send her kids to a local school or for tax or other benefits.

Thats ridiculous. Your landlord should get a P.O. Box for his or her mail. You should have the right to check your mail everyday. Something about that set up is fishy. An apartment mailbox should be available to you everyday. That's like saying you might get your mail this week.

Since your mail (for your residency) is in the mail box, you have every right to it. Since you both share it, you both need a key. Since YOU live there, she should have her mail sent to where SHE lives. Legal options should be the last resort. You might be spending money to gain almost nothing. You should have sorted it out before you moved in. I suggest you talk to her and ask her to give you a copy of the key and that you are a trusting and responsible person. And if she does not agree, contact a local housing committee and ask them to mediate. Ask once verbally than write letters and document everything.

I don't know if it is legal or not, (it should say something about it in the lease) but if I were you, I would find the closest post office or mail center and rent a PO Box. She sounds a little loopy.

umm well like situation kinda differs. from what you said, it does sound illegal. but if you don't pay rent then that's perfectly fine.

Great post! I completely understand your question. Money is hard for a lot of people right now since the enconomy is going down.
