jphert | Landlord sold building. Does the buyer have my security deposit? |

Irregardless if the new owners received your security deposit form the old owners at the closing, the new owners are responsible for the security deposit, hopefully you have proof if the new owners balk latter,
But the law clearly states the security deposit are the property of the tenant held in trust by the landlord in regard to damage to the unit, and the new owners are on the hook even if they did not get the monies from the old landlord, the state would not require you to chase the old landlord for your monies |

The new owner is responsible for your deposit. He received it from the old owner as part of the escrow settlement at the close of the sale. |

You should have checked that out before landlord left, but 99.9% of the time it works out O.K. my landlord sold our building i moved a year later, new landlord had paperwork showing the deposit that was due me upon proper termination of lease...that money's usually in escarow...whenthe building sold...everything goes to new owner. |

Tenants, their leases, and the deposits are "sold" with the building. As part of the sale paperwork the buyer gets a list of all the tenants, the originals of the leases, and how much each deposit is.
When a tenant moves out, the new owner is the one who is responsible for returning the deposits. |

Yes, the security deposit is supposed to be held in a trust fund and the funds in this account are supposed to be transfered to the new owner. There should not be a problem but make sure you don't lose your receipt . If a problem does arise you need it to have any kind of recourse. |

Yes, the new owner would owe you your security deposit when you move out (if you deserve it... ) |

when a building is owned by a new owner, he therefore takes on the reasonables as the old owner. The new owner has your security. |

From what I know the old landlord should have your security deposit unless you resigned a lease with your new landlord.
If he is taking your security deposit you could take it to court and sue him for it but it depends on if the apartment was cleaned up to the landlords standards and what you agreed to in the lease if you did not comply with the lease or if you where a bad tenant (which I doubt you are it just seems as if your landlord is a crook) he has every legal right to keep your deposit to cover any damages that may have been done. It all depends on the situation
If you do take the man to court make sure you have proof of payment for every month you lived in the apartment
Take statements from your neighbors saying good things about you
Take pictures of your apartment to show that you keep it clean and just gather all the evidence that you can to win the judge over
I wish you good luck and I hope this helped |

Highly unlikely. I am a landlord myself and generally speaking, your lease is written so that it is very specific between you and the person that you signed it to. The new owner almost certainly has nothing to do with the original arrangements. Best you can do is ask. Sometimes, though rarely, they will set that stuff up in an escrow account, so it might still be there. |

Unless the buyer was the one whose name was on your lease contract, he's not the one responsible for paying your deposit back. Your landlord is.
As to getting your deposit back...I know California law states that the landlord must return your security deposit within 21 calendar days of your vacating the premises. If he doesn't give you back the full deposit, he is required to send you an itemized list (with receipts) of what he used the money for, which CANNOT include cleaning for "normal wear and tear."
If he doesn't get the check and itemized list back to you within that time period, he loses the right to deduct anything at all and owes you the full deposit...and if he doesn't give it to you immediately, a court will order him to pay the full deposit plus a penalty to you. |

no. your landlord has spent that by now. the 'deposit' doesn't just sit in a safe like you want to believe. if he was going to give it back to you, it would be coming out of the monthly income...
you may have lost that deposit friendo. |
