I was living in an apartment building from August of last year until around May 20th. I always paid rent either on time or early. My roommate and I moved from one unit to a smaller one about two months ago. We never signed a new lease for the new unit. We decided to move out and gave notice on May 1st. We paid all of May's rent. The apartment was unfurnished with a community basement (all 4 apartments could reach it). On June 15th, I get a phone call asking for my new mailing address. I ask, and the landlord says that I will be getting my full deposit back. Yesterday, I get a check for the amount minus $59.94, a print out of the price of a chair off of a website (not a receipt), and a letter claiming that I stole fabric off of chairs in the community basement for a project. I have never seen those chairs. I called them last night and they claimed that they had "strong evidence" that I had stolen the fabric to recover a chair I own (which I don't own any chairs). I asked what evidence and they said the whole apartment complex had seen me take it. I talked to a tenet's right group here and because of my income, I can file a claim in small claims court for free. I don't really care about the money, it's more the principle (they have been the worst landlords I've ever had - would ask to come in without notice at least once a month, wouldn't do anything about neighbors that were partying all night (reason we moved out), and we found out that the basement lights and another unit's hot water were on our electricity, among other things. Could they counter-sue for anything? I would hate to have this come back to bite me, but I really feel like I need to stand up for myself.
