Landlord wants me out of flat.?
I have been living in property for 4 years - renting.
My landlord now has asked me to leave within 2 months (my 12 month contract ends in Sept 2009) as he wants his son to live in the property.
What are my rights?? Can he do this legally???

The legality of the situation is determined by local landlord tenant law. Get online and look them up!

Read your lease agreement. If you live in California, for instance, a landlord can terminate any long-term month-to-month agreement with 60 days notice, in most places. In some rent-control districts, the local laws have tighter restrictions, and any contract that violates these laws cannot be enforced.

So, you should start by searching your laws online, and figure out how they apply to your situation.

If you have a contract that ends in Sept 2009 then you have a contract. Look at your paperwork closely because many of them are 6 month contracts and then take advice, CAB or solicitor.

no he cant unless you owe rent or damaged the property.if you got a contract then go the c.a.b. and get there advice or if he wants you to move before the contract is up ask for a resettlement payment .and don't forget if you put a deposit down when you moved in you want that back in full before vacating the property cos once your out you wont get it

No, that is not legal the way you have described it.

If you have a properly formatted contract (i.e. a lease), he cannot evict you for the simple reason that his son is moving in. You must have failed to fulfill some portion of your lease.

The specific details will vary from jurisdiction to jurisdiction. A good source for local advice would be a tenant's association if there is one in your area.

You have the right to sue your landlord, if he unjustly evicts you, since it's a violation of your lease.

If you are an assured tenant your landlord must give either two months' or 14 days' notice depending on the reason you are being evicted. If the reason is because you have done something wrong (such as rent arrears or antisocial behaviour) the notice will be at least 14 days. If you are being evicted for any other reason the notice must be at least two months.

Firstly, it depends on the law of the land in which you're living. I believe that in England & Wales you can serve a section 21 notice giving 2 months notice that you want to take possession of the property. There are also rights if you want to reclaim it as a family home. It's advisable to speak to a legal expert to fin out your exact position.
