Landlord wants us out?
IN NY state.
About 8/7/07, we made a deposit for a rental home with the remaining to be paid Sept 1/07 at which time we would have drawn up the lease . LL give us the keys and told us that we can move in and he'll be back on 9/1/07 with the lease and to pick up the rent. We moved in a few days later.
Landlord called me on 9/4/07, said that he had a fight with his wife and wants to move into the house immediately and wants us out . I have already set up everything for the home, most of my stuff is in the house, my kids has just switched to this new school.. I told the LL that I will try and be out by the end of the month, he said he can't wait for the end of the month as he's staying at a friends and he needs to move into his house right away.. I told him it's a big inconveinence and he shouldn't have rented the house if he knew he would be needing it whenever he fights with his wife, he said he can't afford the house and he's turning off the electric and the water by 9/14/07.
Additional Details
We are going to leave, but do i have any type of legal rights, I have to consider my kids and school and all that stuff.. I just need some time to find another place, but he wants us out right away.

Make him take you to court.
You know you need to move, but at least that'll stall him. There's nothing he can legally do other than go through the eviction process in a court setting. He CAN'T shut off the electricity. Call the company and let them know to switch it over to your name until you can find a place to move to.
Threaten to file suit if he does shut it off.
Save the money you owe him for rent, don't use it for a deposit, you still owe it to him & likely a judge will ask you to give it to him.
He's being a jerk, so give it right back to him. Make him follow the letter of the law exactly, that'll at least buy you some time to find a new place.
Make sure he understands that he can't just screw you over and expect you to be okay with it!

You'd have to check your local laws on renting. A realtor might know (sometimes they manage property) but really, I don't think you have any recourse because the lease isn't signed.
I would ask that the LL pay your first months rent somewhere else to make it fair.
You may have to halk it up to lesson learned.

This is a sure case of Judge Judy. Talk to a or a realtor with years of experience in leasing or to a lawyer and maybe you can charge these people some money on moving expenses and a free month for your time to find another house where you can move onto. Include the gasoline and food if you can and all the expenses that you have and had to move in and then to move out again. Get all your receipts together. Good luck. Maybe you can just talk to the landlord about paying you such and such amount (you name your amount) so that you don't have to sue and go to the court.

HE CAN'T!! If he does, it is called constructive eviction. If you are not in breach of the lease, he can't just throw you out. I'd call the police if he does. Do you have a lease?

Well legally since there is a lease for a yr he cant do anything about it unless he is selling the house or something. He can not do that to you. And if he can then he has to get it in writing and give you time to find another place. IF you do move you better get back all the money you paid him. EVERY PENNY. You were there not even for a month and have already paid for a full month. I really dont think he can do that to you. I wouldnt give in to him so quickly.

That sucks, but, without a lease or other rental agreement you don't have a leg to stand on, it's a he said, you said thing that has no legal standing in a court of law. With a landlord like that your better off in the long run getting out now. Sorry, good luck

I dont know about the laws in NY, but in BC Canada he has to give you 30 days notice.

Check out the local Tenancy Act in your area. You might be able to get something out of this... but I know for a fact he cant just ring you up and ask you to leave on the spot.

Did you pay rent on Sep 1. If so you may have a case against the landlord. You may still have to move but at a min he needs to refund you the monthly rent. go talk to a local real estate laywer.

thats crap legally you should have 60 to 90 days to be out find a lawyer in the phonebook tell them the situation I had a similar experience the lawyer actually typed up papers for me for free and I submitted them I got extra time to find another place good luck

If you have a lease, that is a legal binding agreement, if it says he can throw you out at any given notice for no reason, the yes, he can do whatever he wants. But if the lease says he has to give you written notice, then he has to give you notice.

Read your lease carefully.

He was probably required to give you a certain amount of time of notice for eviction.

You can also go to court.

What a nutty landlord.
