My landlord has just phoned me up and given me a right ear bashing about my rent not being paid this month. I sent the cheque off at the end of last month, but it has only just came out of my bank account 2 days ago. This is not the first time he has taken over 2 weeks to cash the rent cheque. I asked him when we first moved in for his bank details so I could pay be Standing Order and I am still waiting for them, and I also havent got any official record from him of rent payments. Luckily I have all my bank statement showing when the cheques were cashed. What would happen if he tried to evict me because he says my rent is always late, even though I know it isnt?

I came off the phone actually chaking with anger, he got me so riled up. Even worse is Im still waiting for a load of repairs to be done in the house. I had actually spoken to his wife about 30 minutes earlier asking when they were going to get done, and she was really apologetic and nice, then the ogre calls up and goes ballistic!!! |

He's an idiot. He cant complain about the problem when he's the one causing it. He should just cash the cheque at the appropriate time - it doesn't take a genius to understand that. Most landlords want the rent paid by dd or so - I wonder why he's got a problem with it. Is there a fiddle going on I wonder. |

Your bank statements only prove his point, even if false. You are just showing that the money came out, not when you sent your payment.
Send your paymetnts via certified mail (or what ever your country's equivalent is) - use the signature date as proof of receipt. Alternatively, take your rent directly to him and stand there until he writes you a rent receipt. |

In the US, I paid the extra postage to send my rent checks via Certified mail/RRR so that I could prove I sent it in on time. This worked fine during the interim before we got our banking info all sorted out. |

Bank statement proves nothing about the date the check was sent and received.
Next time send it certified for a few extra buck, make him sign for the check. A card will be sent back to you with the date and signature of delivery. Then the next time he calls to yell at you about the check being "late" you will have proof of the delivery date. |

Trying sending your payment(s) via certified mail. That way you have proof of when you mailed it and when he received it. Also, try finding another place to live - life is too short to put up with such a jerk. |

I am a landlord, and have had these problems too. Once a check was 2 months in getting across town. Postmark and all..
I would send postdated checks to him, thru the end of your lease. They can always be canceled. This is what a lot of landlords do in a college town,,That way the kids can't say they forgot.. Not just the kids, Have a couple of teachers that are always "forgetting" too..
I have in my lease that I will call after 5 pm on date of rent due if not received. and eviction will start after 5 days. I also make calls if rent is overdue more than 3 days now.. All of my renters are due on the 1st or 15th, and I am always available on those dates, so that they can communicate with me, but it is always the one late that says they want to see me, but could not find me home. |

unless you have proof that he is holding and waiting to cash...its his word against yours...have him show you the postage date on the outside of the envelope...that will prove when he got them...Otherwise...use certified mail... |
