Landlord wont fix anything?
ok i posed a question on here 2 weeks ago about having problems with my landlord not fixing things and that they had been going on since i moved here in may i.e. sewage backing up into the house flooding 3 rooms black mold growing in the laundry room and thats just to name a few i wrote him a detailed letter giving him 14 days to fix the problems as i have had enough this is now day 16 and still nothing what should i do now i have thought about just moving but i want my 800 dollar deposit back yea and by the way ive been paying 800 a month to live in this dump someone help please i need to know what i can do legally only real honest answers please i am in a bind and desperately need some good advice.

If I was you I would be sure to take pictures of all the problems you have had there. Make sure you save copies of everything you have sent the landlord. Call your local court house and see what they advise you to do and how to go about withholding rent. From what I understand you can withhold rent if repairs are not done. You just have to make sure you go about it the right way. Good luck with all of this.


Step1. Read up on state law and statutes and learn the specific terms, conditions and requirements that govern rent withholding. This includes what notice you must give the landlord, where the rent must go and which landlord violations justify rent withholding.
Step2. Inform the landlord in writing via certified or "return receipt" mail what the problem is and that you plan to withhold rent unless the problem is addressed. Include a copy of the law or statute that governs rent withholding in your state. Retain a copy of the letter and the law for your records.
Step3. Wait for a reply. If no reply comes, send a second certified letter imposing a repair deadline.
Step4. Visit your local or county courthouse and file the necessary papers to legally withhold rent from the landlord.
Step5. Deposit the rent in an escrow account maintained by the court or a neutral third party (such as a mediating service). Even if your state doesn't require this, it makes your case look better if the money is out of your
Tips & Warnings:
Maintain copies of all photographs (of your rental and areas to be repaired) and correspondence between you and your landlord.
Many towns and cities have supplemental tenants' rights laws, so check with your city or county government for legal information as well.
Don't withhold rent unless you are absolutely certain that your landlord's transgression justifies doing so under your state's laws and statutes. Otherwise, you could be evicted immediately

If you have given your landlord a 14 day notice to cure and the roblems have not been addressed then I would say it is time to move. I would now take pictures and well document all of your issues as well as have a copy of the letter you sent. You will need to give your landlord a 30 day notice of your intent to move and your expectations of getting your deposit back. Besure to state that "they" broke there end of the lease agreement and that if your deposit is not returned you will take legal action.

Move. Videotape/photograph all the stuff. Call the building inspectors. Tell him if he doesn't return your full deposit you will sue him to the greatest limits allowed by law.

Call the city or the state. Landlords have rules they have to obey. Sewage backing up is a health issue. Start with the health department. Most states have laws that the tenant can get things repaired and deduct the repair from their rent if they made a good faith effort to get the landlord to do it. Make some phone calls and find out the laws where you live.

First get yourself out of there. Your health is at risk. E. coli from raw sewage bad news. ,s chartarum (A.K.A. black mold) can cause everything from headaches to bleeding from the lungs and nose.

My peers are well intentioned. The law across the nation is
rather consistent re this topic;

YOU need to give the landlord a 30 days' written notice on
all maintenance issues needing repair in/for your unit.
---if he does not repair same or hire it done, within the 30 days,
you are obligated to call a licensed contractor. Get a bid.
Ideally, call 3. The lowest bid of a licensed C is your route to
success. YOU must hire and pay for the work to be done; you
may not ask the repair firm to send the bill to the landlord.

minus the amount paid for the repairs, and send a copy of the paid receipt. IF the amount is higher than your rent, up to 2x,

sufficient safety issues, toilet, AC, water, door, window or
whatever........that if you feel your health and safety is vulnerable,
you may leave, lock stock and barrel and inform the landlord
that you are being CONSTRUCTIVELY EVICTED and explain
the dilemma. The landlord has the right to try to cure the problem
to YOUR satisfaction. IF he cannot, you are gone and he refunds
the deposit and any unearned rent he has of yours.

That is the law! IF he wishes to contest your definition of
the grounds for CE, he may in court.

if u signed a contract u can read the terms under maintenance and if it is a term then ur care-taker has to take care of it and u could have a claim against him if he does not fix it soon enough because u can't let ur tenant live in unsafe sewer conditions. so try look at ur terms and conditions of ur contract if u did sign any

goodluck and don't take no sh*t if u move out he's down 800 a month and nobody else is gonna buy or rent a place that has a sewage problem.
