First off, do not withhold your rent...this gives him just cause to terminate your lease. Go to the tenant laws for your state...Google (YourState) tenant rights. This could possily be a matter of health and safety. Send the certified letter, 72 hours for them to repair. If not repaired, send another certified letter, stating the same. If they do not repair within the first 72 hours, go ahead and turn them in to code enforcement in your area.
But, whatever you do, do not withhold your rent, unless you have another place to go.

Send him a certified mail letter giving him 72 hours to respond, also heating and hot water is part of your lease agreement, in the certified letter tell your lanlord he has 24 hours to get back to you, or you will get it fixed yourself and deduct it from next months rent |

just leave him a message politely saying "we have no hot water and we have children, we are giving you 48 hours to make arrangements to have it fixed, if not we are contacting the state housing dept". when you contact the state they will send someone to survey the problem. if in fact t is they will fine and place al ien on the property untilt he situation is rectified this way he cannot try to evict you if he refuses to fix it. he will be required tod o so before they will remove the lien. but be careful if u have no lease bc if u have no lease he will surely evict you after all of this is said and done. |

He sounds like my ex boyfriend's landlord, who is a friend of his AND his boss at one of his jobs. What you should do if you really wanna get the message through to him is call your local fire department, and ask to talk to the fire chief. out here anyway, they are the ones designated to handle renter/landlord disputes and this is definatly an issue. That is what my ex did, and things are slowly improving at his place, although they have a LONG way to go, as the roof needs fixing cause it leaks in his kitchen every time it rains. Since you have kids, I say do this ASAP. good luck, I hope things get fixed for you. |

Do you have a written rental agreement with him? If so, there should be something in there about how essential items are to be repaired. Follow that guideline. If not, send him a certified letter stating that he has 3 days to repair it or you will have it repaired and deduct it from your next months rent. Make sure you get paperwork when it's repaired and send a copy to him when you pay the next month's rent. |

May be because he being your family friend he knows very well that you would not take up any ulterior steps against him or leave he premises as well ! Therefore my humble advice would be to tackle the problem as friendly as he is to you, for mutual benefit! |

I would take a look at your lease and see what it says you are responsible for. You may have been jipped on the lease, and if it says your are responsible for taking care of the appliances, etc. then you are going to have to take care of it. If not I would contact your attorney, you may have a cival matter on your hands. It sounds like you have an SOB landlord for one. Also about the gas safety check, it is the landlord or homeowner's responsibility to get those done routinely. You may want to let the local Code Enforcement Office know, although they may send you to your attorney as well. I hope this has helped. |

Most states have very strict laws and regulation governing the rental of apartment properties, whether it's homes, parts of a home, or complexes.
You will need to check in your phone book's yellow pages under Government to find out the name of the appropriate agency in your locality. The city clerk's office can also help you find the correct information.
I won't speak for all areas, but most are very specific about the provision of basic utilities. Anything that is an integral part of the home, such as furnace, water heater, etc, usually falls under the obligation of the owner to repair, and must be maintained in working order to comply with the law.
If your landlord is dodging you, contact your local agency to force immediate compliance. He's looking at fines and a possible lawsuit from you. Time, though, is of the essence, so dicking around with certified mail and such is probably not much help right now.
That he is also a 'family friend' only serves to make his position even more precarious in court. Do it now and forget about the 'friendship' part. Friends don't screw friends over. The law is there to protect you in these exact situations, so use them. |

It's tough being a family friend, but it needs to get done.
A few options that you can pick from depending on your relationship with him.
1.) Tell him if he doesn't get it fixed, you will be forced to relocate. This is tough, because he could just call your bluff, and then you will be stuck moving out.
2.) If you have the funds available, make an offer to him that you will pay for the repair costs, you will turn the bills into him, with the understanding he will credit your rent equal to the repair costs going forward.
3.) Arrange for the repair yourself, and have the bills sent directly to him. |

I would go to your local citizins advice bureau asap, get that landlord reported! that is a very serious problem. . .carbon monoxide is a silent killer you cant smell i and your boiler could be leaking it. . . for the meantime i would geta few carbon monoxide detecters and check them regularly until your boiler is fixed and safety checked! |

ALL gas boilers ( especially those in rented accomodation ) should be inspected once a year by a qualified C.O.R.G.I. gas fitter and no one else,,,,,Your best bet would either to contact the CAB and get advice and possibly a letter or take action via a solicitor,,,,you have many more rights than he thinks you do,,,your life IS at risk if the boiler is not inspected and repaired,,,, |

Contact you local tenants union or if you don't have one in your area, contact your county attorney to check for the landlord/tenant laws in your area.
You should not have to put up with that - if you lease says hot water and heat are provided, then they MUST provide them.
In most areas, you can legally withhold your rent - but you need to be careful and follow all of the local rules about this. If your landlord takes you to court - it will be the same court you filed the initial complaint with. So don't let the landlord intimidate you once you find out what the rules are in your area.
Keep in mind that most Tenant / Landlord law is written in favor of the Landlord, but that doesn't mean they can do whatever they want. Hopefully, you will have good laws or a tenants union in your area.

Even if he is a family friend, you should not treat this lightly. You should remind him that you have kids and that by him not fixing it, he could be charged with child neglect necause he knowingly does not fix it yet the kids live there. Anyways, hope this helps. |

You need to make it clear to him that he must fix the problem or you will go to the police. Thats too dangerous a situtation with children involved. It is the landlord's responsibilty to either fix the problem or hire someone to do it. That can be difficult considering hes a family friend but your childrens welfare is more important than a friendship. If you does not respond than you do need to contact law enforcment. |
