i rent out a house which i've had a tenant in for about 3 years.
he is complaining that some of the walls are marked and could do with a fresh coat of paint.
i'm not hugely experienced in looking after tenants so forgive my ignorance here !
i didn't think that it's my obligation to keep the paint looking `fresh' . surely if it's something superficial this is something he should do? or am i wrong ?
fair enough if it's something quite major and something needs re - plastering etc . but if he just wants it freshened up is this really down to me ? it doesnt look that bad to me just a few superficial marks !

This is a decorating issue and up to him to keep up.
Marks on the wall are not normal and you would charge him to repaint over them when he left, so you should not have to pay while he is there.
Personally I would offer to pay for the paint if he does the painting. It should not be more then 20 bucks, if we are just talking about one room. |

If your tenant is a good tenant, I would try to keep him/her happy. A fresh coat of paint is alot cheaper than trying to find a new, good tenant. You could offer to pay for the paint if the tenant is willing to to it himself. |

I have been renting the house that I live at for going on 3 years now. When I first moved into the home the walls were multi-colored. A few walls are a maroonish color, other walls a tan like color, and the dining room walls were pee yellow. The room that was going to be my daughters was blood red. I was not happy with how the walls looked, and I had mentioned it to my landlord. He took off a few hundred from our rent. We used to money that he had took off for paint and painted ourselves.
The housing market is really bad right now. If I were you I'd make the tenant happy by getting the walls painted. |

Superficial marking as a rule falls under fair wear and tear, you should have a tenancy agreement for the let which outlines responsibility, but as the landlord it is your responsibility to maintain the property. These works though are not 'necessary', but if he is a long term tenant it might be in your best interest to do the repaint. It will keep the tenant happy but also if you come to re-market in the near future it will help to get a new tenant.
You could always offer to buy the paint and for him to do the work as a compromise. |

The industry standard by professional painters is to paint every 4-5 years unless the walls are faded, dirty, damaged (by cigarette smoke or something else), etc.
Reputable property managers/landlords will repaint a property after each tenant. Talk with your tenant and see what his/her intentions are. If they are looking to leave whenever their lease expires, you will need to repaint anyway. If they are going to renew their lease and you enjoy having them as tenants, I would reapint it anyway - you may be able to get another few years out of them! |

Pretty much what he's asking for is cosmetic work and you are not responsible for "cosmetic" work around the house, this is usually something that you'd do when your tenant moves out. If there are marks on the wall then they were probably caused by him.
It's really a gray area here, you can keep your tenant happy by telling him he can go ahead and paint it and deduct it from his rent (put a cap on the amount so he doesn't go nutty) or you can get someone in to do it for you.
Legally you aren't responsible for keeping the place looking "fresh" every couple of years. your responsibility lies with the general upkeep of the property, the electrical, the plumbing, the appliances, heating and ac everything else like walls and carpet are cosmetic.
If he's a good tenant and pays timely and you'd like to keep him then its a judgement call on your end.
If his lease is up for renewal he might be negotiating the painting before renewing his lease. If it's not up for renewal tell him you'll repaint at lease renewal. That's usually something the apartment complex will do upon lease renewal if the tenant has been there along time. Most complexes allow the tenant to paint as long as they put it back to the condition it was before they moved in. |

A coat of paint would normally be classed as general wear and tear but I would have thought that a landlord would need to paint over any marks after the tenant has moved out.
If the tenant caused the marks then it's their fault and if they have a real problem with it, let them do the painting - obviously with you getting final say on the colour etc. |

Hi there,
As a landlord, you are obligated to pay for anything that declines due to daily wear and tear. If he'd taken a chunk out of the wall by moving some furniture, that would be down to him to fix it. But as the marks are superficial and just through daily wear, it is unfortunately your responsibility! Every 2-3 years (as well as between tenants) is a reasonable amount of time.
Most tenants who live in a property for a long time tend to decorate themselves with the landlord's permission! I can't really imagine why he wouldn't want to choose his own colours, etc - but there you go!
So yes, you are obligated to buy the paint. Whether you actually do the painting, pay for decorators, or he agrees to paint it himself, is down to the two of you to agree on! Most people would do the painting themselves as a courtesy for you buying the paint - but technically, you are responsible for getting the paint on the walls, one way or another!

Take him with you to the home center's [Loew's; Home Depot, hardware store] paint dep't.
Let him pick a neutral color or the color matching the one currently on the wall or in the room. NOTHING expensive
Buy the paint, roller, tarp and pan.
Hand everything to him and say, "Here you are! The rest is up to you!"
AND DON'T allow or give any reduction in rent!

Scuffs and marks on the wall are normal wear and tear. I wouldn't think that you would be responsible for repainting the house because the tenant marked up the walls.
I also would never let a tenant paint!!! Believe me it could wind up costing you more money in the long run.
If the tenant has been a good tenant for the past three years it is worth trying to keep them happy. So, spending a little bit of money on TOUCHING UP the marks on the walls yourself might be a good investment. |
