My parents own 3 houses that they rent out to people. They have done this for about 6 years. This is the first time they are having problems with a tenant. They don't pay their rent until they are given a notice to pay to 7 days or move out. Also EVERY check they have given has bounced. They NEVER switched the utilities to their name, it is still in my dad's name, but they refuse to pay them. The utility companies will not shut off their service until they are behind by a certain amount. All this is new to my parents, and they are researching their options, but I was wondering if anyone could give any tips or advice that I could pass along to my parents.

Have your parents send a letter to their tenants stating that check payments are no longer accepted. Then they should return any check payments they receive from the problem tenants. One can always refuse to accept check payments -- especially from someone with a history of writing bad checks.
Your parents need to tell the utility companies that they will no longer in possession of the properties and will not pay utilities. I've never heard of a utility forcing someone to be a customer. Whether or not the tenants decide to turn-on services doesn't matter.
Depending on the lease and state's laws, your parents can probably issue a warning letter stating that tenants are in violation of the lease (i.e. failing to pay on-time, switch utilities, paying past due balance for utilities/NSF fees, etc.) and have 10 days (of whatever notice required by law) to comply with the rental agreement. If they don't comply or pay late again then your parents can probably issue a For Cause Termination and go to court for an eviction.
If your parents are uncomfortable managing their properties, then they should consider hiring a property management company or a lawyer that specializes in rentals. Some property management firms will even contract for one eviction. |

Your parents can also require cash payments and evict them (eventually this will lead to an eviction, your parents have a loser in their property) if they do not comply. |

Your parents do not reside in the residence so for the utilities send WRITTEN notice by CERTIFIED mail (keep a copy) that if they don't put the utilities in their name within 30 days they will be turned off. Then your parents can let the bills run up be turned off, pay it and not turn it back on - also is there a lease? If there is it should state what utilities the tenants are responsible for, if they haven't lived up to the terms of the lease it is grounds for legal eviction. Also stop sending notices that they have 7 days to pay the rent. Legally tenants have to pay in full no later than the 10th of every month- after that your parents can start eviction with no further notice. It's a simple form at the courthouse. They can also be charged for all the bounced checks as long as your parents keep copies. My advice is to go for the eviction, skip the utilities game. |

Unfortunately, your parents are idiots. I'm sorry.They have blithely cashed the rent checks each month and cut the grass, content that life is good and there are no problems in the world. A good landlord is not a "nice guy." He is always on his toes defending his empire.
They should have instructed all the utilities that "as of [this date] we are no longer responsible for the bills on this property - disconnect all service." It's up to the tenants to get them turned back on. Your only favor to the tenant might be to be there for the workmen to read the meters for the switchover, etc.
For someone who is late with their rent it is best to get ahead of the problem immediately. You can always back off later, but you have to show strength from the start. The day after your grace period (if you have one) you should issue A Three Day Notice to Pay or Quit. After 3 days you issue a Thirty Day Notice to Vacate and go to the courthouse to find out how to take the tenant to court and file the paperwork as soon as allowed.
At any time during this process you can rescind the case if the tenant catches-up, including the court costs. I have found that many tenants are so shocked that you'd actually do this that many are never late again.
If they are habitually late this can be a reason for eviction in itself. There should be substantial late penalties included as a clause in the lease. It should HURT to pay late. |
