Lease ends 6th of October. Should landlord have to prorate me if I want out by 6th?
I live in Washington state. I am on a 6 month lease and was wondering if I have to pay in full for my last months rent. I want to give them 30 days notice by the 6th of September. Are they required by law to prorate my rent.

If you are paying on the 6th of each month, then you are paid thru Oct 6 and there is no proration. If you pay thru the 30th of Sept, then you prorate the 6 days in October.

If your rent is always due on the 6th and you want to move, you give 30 days notice when you pay rent on September 6th. That will pay through Oct 6th. If your out by that date no further rent will be due.

Your lease should govern. If the lease ends on Oct. 6th as you indicated then that is what you will pay rent through. If it ends on Oct. 31st then you are liable for the full month of October. Read your lease.

no. you signed a lease till October so you are legally bound to pay till October. your landlord can prorate if he wants to like if he has someone anxious to take the place but he has no legal obligation to.

Read your original lease!!!

If the landlord started your lease on April 6th and the landlord accepted a prorated amount in April, it is reasonable you will be required to pay a prorated month in October. There is no law that precedes the contract on this issue.

Unless it's specifically mentioned in the lease that you get a prorated final month (which is rare) no your landlord can charge you for a whole month. If you don't give thirty days notice he can even get you for yet another month.

You can try asking nicely but don't count on it.

You have to pay for in full all the amounts due in the lease, so ifs 6 month lease, you need to pay 6 months worth of rent.
Because its end of lease, just give them the normal notice so they can advertise.


Create Zen
Depending on the management company, some require a 30 day notice and some require a 60 day notice. To avoid paying anything more than what you have to, I would submit the notice to vacate ASAP.

If the management company requires only a 30 day notice, then to avoid excess charges you must submit the notice to vacate on or before September 6th.

If the management company requires a 60 day notice, there is a possibility that you would have to pay extra - up until the sixty days from the date you have submitted the notice to vacate.

They are required to in california. Its strange that your lease ends on the 6th, im assuming your rent is due on the 1st. Either way dont pay in full for the month of september. Tell them youll pay the prorate and if they won't do it just don't pay them until they send you legal documentation, at which point any small claims judge would rule in your favour(if they bothered to take you to court) also write it in a letter that youre willing to pay for the five days, and keep a copy for yourself.
