no if the lease expires your ex needs to sign a new lease with the landlord and it should not include your name on it because you are no longer living at the residence. if the landlord refuses to do so threaten to hire a real estate attorney that will usually scare them into doing what they are suposed to do |

Here is the problem:
You have a contract with the landlord, not the boyfriend.
30-days prior to the end of the lease, you should have called the landlord and told them that you would not be re-signing...that was your notice...if your boyfriend paid the rent so you didn't have to...hooray...hooray, but that still doesn't get you out of the legal obligation to the lease..that just means you had a boyfriend who was nice enough to pay the entire thing.
It doesn't make any difference when you moved out.
The boyfriend doesn't credit-qualify, most likely, on his own.
So, to get out of it, you have to provide the landlord with a 30-day notice (or 60, depending on what the lease says), and THAT is when your lease truly ends.
Most leases have a provision that the original lease will continue unless terminated by either party with appropriate notice.
But you MUST give a notice.
Be sure to send the notice, certified mail, return receipt, signature required...send another copy to your ex.
PS: Be very nice to your ex b/c legally, he can sue you for 50% of the rent if he wants to. |

You are going to insist that your ex sign a NEW lease since the old has since expired; that's the way it should be presented to the landlord. Read the fine print in the old lease and make sure there's not some month to month clause that exists after the initial 15 months.

If the lease automatically renewed or converted to a month to month lease, unless both tenants listed on the lease give proper written notice AND both tenants vacate the property per the written notice, the landlord can still hold you liable.

Sit down write out a letter to them stating you haven't lived there since such and such day and since the other party wishes to remain you would like your name to be removed from the apartment since you are not longer living there and will not be held liable for any damages or problems which may occur. Send Certified Mail Return Receipt Requested. About $5 to do this remember to keep a copy for yourself. |

Depending on the state laws where you live and the way the lease reads......if the lease stipulates that you would be on a month-by-month basis after the lease was up than it is still legally binding. If the lease expired and it has no clause about month-to-month and she is letting him stay there anyway she can blow that contract out of her *** and it should have nothing to do with you. |

if the lease has expired and you moved out, there is no way they can hold you responsible for anything - she should insist on a new lease with your ex only on it if he is staying - send them a letter in writing - verbal is not good enough - get it certified - signature required if necessary stataing that the original lease went from x to y with you and him on it. the lease had ended and you are giving written notice that you no longer live there - theta might be the issue - you just can't leave without giving proper notice and expect them to remove you - YOU have to follow the rules in the lease too - which probably said you must give 30-60 days written notice before lease ends if you intend to NOT renew it. At this point the lease should just be month to month, so giving written notice now should protect you |

if the lease expired a new one needs to be signed. if you don't sign it then there is no problem. she won't remove you from the old one and that's fine. however, you won't be on the new one either. so let it go and move on. if anything in the future happens, tell them you never signed a new lease. don't let peoples stupidity bother you |

You don't have to sign again beyond the first 15 months you agreed to. If she tries to bug you about it again call an attorney and see what they have to say about it. |

It is illegal to not end an unrenewed contract upon expiration. If he still lives there, then he can take out a new lease without you on it. You absolutely need to report this person to the cops so that if you do get any demands of legal action forcing you to pay his rent, then you will have an official record with the police of the situation. If you don't go to the cops, you will be SOL if/when he gets evicted and they want the money from you as he said she said wont hold up in civil court. Best of luck and take care :) |

Thats not even legal and your landlord knows it. If you have a copy of the new lease (and she should give it to you if your name is on it), then take it to the local magistrate along with mail you are receiving at your present address and any other proof of address you may have providing proof of residence any place other than the address on that lease. Take care of this asap cuz youre credit can end up jeopardized! I hope you took all utilities out of your name...... |
