Dave | Leaving a Rented Home - where do I stand? |
Hi, I used to rent a house (in the UK), but handed my notice in & left. My official leaving date was 31st of May, however, (and I informed the letting agent of this at the time), I planned to move out earlier than that, as I was moving out the country. I handed my keys back at the beginning of May, and I had an email a couple of days later from the letting agent saying that they had done the 'checkout', and had a list of bits of work that needed doing, which they would take out of my deposit. I said fine to all of it (just minor bits). I've still not yet received the rest of my deposit, but they tell me that's because my tenancy didn't officially end until the 31st May - I'm fine with that.
However, I've had an email from the letting agent today telling me that they have just visited the property, and that the grass is now too long and that they want me to pay (ie take out of my deposit) for getting the grass cut. Can they do this, seeing as they had they keys & done the checkout? Additional Details just to add -
their reasoning for wanting to charge for getting the grass cut, is again due to the fact that my official end date is 31st May, even though they know I'm not in the country, that they have the keys & that they have already done a 'checkout' on the property.

I think this is a very unacceptable behavior. I am really sad to hear your story because it shows how greedy people are. Letting agencies and homeowners often mistreat people this way ..shameful.
You have checked out and they do not have the right to keep money from your deposit.
I suggest you contact the Citizens Advice Bureau (Law center). Try the following numbers:
020-76072461 or 020 6979310 (late afternoon appointment) or 020-78317079.
You might be redirected to a center near the area you lived.
Additionally, new laws have been introduced to protect tenants deposits ( I think from April 2007) and agencies and homeowners are no longer allowed to keep deposits in their account. If you had your contract signed after April 2007, you must then be protected under with these new laws.
Good luck and I hope you do not give up with these nasty people. |

If in your lease, you were responsible for cutting the grass, they can bill you for it. It doesn't matter that you had already turned in the keys and left. You were paid through the end of the month and should have made arrangements to have the grass cut in your absense.
However, if the grass was not your responsibility, they cannot charge you for it now. |

Yes they can do this, but having the grass cut can't be much more than say £30, so whats the problem, just pay to have it cut. |

Sorry to say you are wrong the letting agent is right. You were responsible for the grass and any other things that could have gone amiss in the house as you were the legal tenant until 31st May. Don't purse this it will cost you more money. |

No they can't do this. Not when they have said that they have done the check out and have taken receipt of the keys.
I wouldn't be surprised if they will also charged the owner of the property for grass cutting as well - just to make the most money!
Write a strongly worded email saying that you have done your best to work with them and had assurances that the check out had been done and to try and charge you for other jobs is completely unnaceptable - tell them you want the rest of your deposit (with no further deductions) within 7 days or you will take it further... |

If they did the checkout early, (naughty, naughty of them), and did not mention the grass then, they are on a sticky wicket. By doing this they have agreed to take over the remaining time, and have taken the Checkout and the problems at that time. They can not decide to add on for growing grass, it does grow this time of year. I think some of this is that you are not in the country, and possibly the landlord is unhappy that the grass is long and unsightly for prospective tenants, and they are looking to find some money to do it.
Write to them, email, and say that the checkout was done early, and you agreed to the findings, but you are not happy with the grass situation, and you require your deposit back minus the agreed things with-in 14 days or you will instruct court action. You could have a friend still here. |

Unfortunately they can...just as you have the right to show back up & stay there until the 31st of May. It sucks, but your contract is through May & the property is your responsibility until then. |

Wow - sounds like they are really milking you, knowing full well you are not in the UK and unable to easily get to them.
I used to rent a flat and in the contract it stated various terms, including the regular washing of the windows, curtains and mowing of the lawn. All well and good, but the previous tenants left the garden like a jungle and they weren't charged for the work !
Are you able to speak direct to the Landlord? If yes, give them a bell as the agents may be trying to pull a fast one with them too. |

Do you have proof of the exact date of them doing the "check out" and supposedly the final tally of what you needed to pay for out of your deposit? Did you pay your last months rent?
Technically, the "check out" done by them is officially your END DATE. They would be responsible for cutting the grass then. Futhermore, they CANNOT rent it until June 1 or you are owed some money back on the RENT you paid.
Sounds like they are nickle and diming you to death. Be careful they may try to get additional money from you over and above your deposit. SInce you are out of the country ~ you would have a difficult time proving anything since you are there. This is a tough one..................they are trying to KEEP your whole deposit and drumming up as many things as they can think of to charge you for. You might have to chalk it up to a learning experience and be OK with NOT getting any of your deposit back. Hope that's not the case though. Sometimes people can be so "cheating and deceitful" about anything and everything. What ever happened to FAIR IS FAIR ??? |

What a crock of poo. They're taking you for a ride there mate. I moved out of my rented house at the beginning of the year two weeks before my tenancy was up and I got most of my deposit back minus some cash for some stuff I hadn't cleaned properly which was fair enough.
No way should they be charging you for cutting the grass. They're taking advantage. |
