Me and my 2 friends leased an apartment together, broke the lease and now owe the company 2,500. Its now preventing myself from leasing my own apartment, and they dont even plan on paying it because they live with their parents.My Question is if I pay my portion, keep the reciepts, and take them to court is there any way I can have my name cleared from the lease and the amount owed? The Company said there is no way to divide it, and we are all together. But I want to Take this to Court!

You would probably have to pay it all and then take your friends to court. I think that is the way it works.

If they are part of the lease and broke it, they are still responsible. Consult a lawyer.

1stly, does the contract consist the names of all parties or only yourself?

2ndly, if the contract does have the names of all, then you WILL have a case against them.

3rd, if not then, simply you have no claim against them

Welcome to the world of renting and leases. The management company is correct. When you sign a lease, even if you have a PERSONAL agreement to split the rents, each of you is fully liable for the total amount of the rents due. If your friends skip out, you are stuck. All three of you will have blemished credit reports for non payment.

You are far from the first person to learn this painful and expensive lesson.

This is a very simple problem, take it to court. They will talk about if you may or may not take your name off the lease and the amount owed. Trust me, I am a Legal Adviser.

If you all signed the lease you all are responsible for the terms of the lease, including the payments.

If you look closely at the wording of the lease, you are all responsible together or separably for the terms of the lease including the payments. This means that the leasing company doesn't care who pays the money, just that it is paid.

You should pay your portion, but it does not release you from the liability of paying the other's portions if you want your name cleared.

You can sue your friends and likely win, but then you need to collect the money, and good luck with that. If they aren't paying you now, what's going to make them pay after you sue them?

You signed a contract and agreed to be separably liable for the lease payments. The court is highly unlikely to break that contract.

I would talk to an attorney that specializes in real estate. Open up your phone book - call your local bar assocation (probably county). Ask them if they have a "Lawyer Referral Service" and/or if they will give you any names of attorneys that do real estate and/or contracts.

When you call the law offices, #1 first thing, ask them what their payment policy is, if they will take payments.
