Legal advice for eviction , anyone plllllllllleeeeeeeeeaaaaa...
So i am getting evicted. Ihave tried everything under the sun to try to stop this but its useless. I went to court yesterday and the judge gave me till 8/31/2007 to get out of the apartment. Despite the fact that i have been paying what i owe and the rent slowly they just won't give me the time i need. I don't have the money to pay for all my stuff to be moved immediately and can only rely on my upcoming checks. I don't have a place to go to , i am alone in the state i live in ,no fam or friends. I just called the landlord to see if i pay this months rent if he will give me atleast 30 days to leave so that i could properly find a place to live cause otherwise i will be in the streets. and he is so rude , harrassed me and said no! I am wondering can i do an Order to show cause asking the court to give me 30 days to leave. I am so scared i don't want to live in the streets pleaaseee any advice will help , thanks!

Everybody has their own circumstances. The landlord has their own costs/bills, it is not just the tenants that have to worry about money constraints. Your landlord is probably desperate to recoup the the loss of income because of your non-payments as well.

Shove your stuff at a rental storage facility and look for a sublet/temp roommate or the YMCA.

While I feel for you and your problem, unfortunately you caused it. Continuously late rent is a no no with me also. It is not up to your landlord to help you out. Contact a family member to see if they will help you. I hope so. Because let me tell you what happens next. If on the 31st you are not moved out, the landlord notifys the sheriff department who in turn comes to your apt with the landlord and while the landlord is changing the locks, the sheriff is moving your stuff out to the street.
This obviously has been going on for a while. You apparently got in over your head and took an apt that you couldnt afford.
The court will not give you another 30 days to move. They already heard the case and gave you until the 31st.
See if your employer will give you an advance on your paycheck to find another place to live. Otherwise, no one can help you but yourself.

I am truly sorry for your situation. However, once the judge has ruled the only thing that could save you is to cut a deal with the landlord. Now that the landlord has refused that, the only thing left is to either move out, or have the landlord show up on the doorstep with the Sheriff Deputy.

The trouble is, as far as the landlord goes, if they give in and allow you to stay, then you don't pay and don't leave, the landlord would have to go through all the time and expense of an eviction against you all over again, so at this point, legally you are out of options.

You could file a show cause order, but you would have to have a huge reason, like you could prove the landlord gave false information at the eviction hearing, for even the possibility to get anything out of it. So unless you there is something you haven't said, that would be a waste of your time, and probably anger the judge.

I would call around to local churches and shelters to see if there might be someone or some group that could give you a place to stay for a few days, and maybe a place to put your things in storage until you can come up with a new place to stay.

Best is to go to the welfare department or what ever theycall it now. see what they have to say and also check with legal aid about getting a lawyer to help you.

If you have put yourself in the position of having more to pay than you cna afford then you do need to change something.

Definately go to legal aid and get a lawyer.

If the eviction is imminent, and I would say 3 days is pretty imminent, this is what I would do if I were you.

Put a sign up on nearby corners and in the yard and start selling your stuff. Take the money you were going to send the landlord and the money from your sale and go and rent a efficiency apartment from a hotel. Most cheap hotels offer weekly rates and depending on what part of the country you live in they could be as cheap as $80 a week, or much more, it just depends.

I really don't see where you have any other option. At the point the judge has set a date, you are out of options that could keep you in your apartment. Realize that if you choose to do nothing, the landlord will haul your stuff out of the apartment on the 1st and throw it in the yard and all your stuff would be stolen anyway.

Sorry for your problems, but I hope you have learned a valuable lesson, rent is your most important expense!

And as a last note, I checked out your other questions and let me see if I fully understand.

You are being evicted for nonpayment of rent, yet you are trying to get pregnant & you rented an apartment for your father in your name. Why can't you move into that apartment?

Sounds like multiple bad decisions and skewed priorities are catching up with you.

Try to tell us what state you live in so that people familiar with the laws of that state and the agencies in that area can respond.

Try calling the local women's shelter to see if they will help. Also, are you affiliated with any church or religious group? Sometimes they will help.

Is there a college or university in your town? See if anyone is looking for a roommate. The rent is usually not too much and the leases will be up in the spring so you can have time to get on your feet and decide what you want to do.

You can rent a storage facility for under $50 a month (you might have to only take the bare necessities). Some storage places will bring a truck to your location and pick up your items for free (if they are boxed and ready to go). Then they will drive the truck to the storage place and park it by your unit. Then you can unload it. The place that does this in my state is called "Space Center Storage."

Also, to make more money, look for temp agencies that provide day labor. You go to their office and wait. Then a factory or someplace calls and they send out as many workers as the place needs that day (like if regular workers call in sick). You get bussed there and work all day, then come back to the agency and are issued a check that day. Call around to see if there's someplace that offers this. You can also call around to plasma donation centers. Some centers offer first timers $100 in a week. You'll have to go 2 or 3 times that week, but it's a quick way to make money if you can do it.

Consider pawning anything you have that is valuable. Do you have a guitar or new video game system? Put it in pawn. Use the money you get to help you move, then pay off the pawn using the checks you'll get in the future. Just make sure to pay it off before the deadline.
