I just moved into my apartment last month. 3 weeks ago I was watching TV in my living room and heard someone trying to enter my apartment without knocking. They were putting a key in my lock and trying to open the door. I had the inside deadbolt locked so they couldn't get in. When they stopped trying to enter I looked in the window and saw the guy leave. I was so scared because my husband was at work and i was alone. I called the front office and they said it was maintenance trying to change my ac air filter. I asked why they didn't knock and why they would enter anyways without permission. All she said was she would tell him to knock and she sent him back. He knocked on the door, I let him in and he hung his keys on the door and left the door open. All my AC was blowing outside and most importantly I have 3 cats and I don't want them going outside. And like the apartment said, they aren't reliable if anything is missing stolen or broken. I understand that, and that is why I don't want them in there. What if one of my cats runs away or gets hurt? They are UN replaceable. I am scared to leave my apartment and come home and find someone in there, find what little stuff we have taken or broken or not know they entered at all.... sooooooooooo Do i have any right at all to keep them from entering my apartment? what if i was sleeping and woke up to go to the bathroom and he was in the hall way?!!!! help please! what are my rights?! I have done property management and they can enter your apartment at any time for an emergency. However, in the case of changing filters or something in that nature they are required by law (atleast in my state) to give all tenants written notice (atleast 24 hours). I would check your lease agreement to see exactly how it is written, I always had my maintenance guys knock on the door first (just common courtesy) even in the case of an emergency. |

Check your lease. Most places have to give 24 hours notice. I would lose my mind if a landlord started rooting around in my home without notice and without knocking. |

look at your lease. if it says that they can enter the unit anytime between 8 to 5 for maintenance then you don't have any recourse. they should call in advance though to let you know and an approximate time. as far as leaving the door open since you were home he did it for his and your protection. that is in case anything happened, or you claimed that he tried anything funny you wouldn't have a leg to stand on because the door was opened and you could have fled. |

Texas has no statute of law on notice of entry. Unless notice is required as part of your lease, they can enter at will.
You can cover your door with notes...it won't matter if state law allow them to enter at will. |

Here is what you need to understand:
You don't own the property and the owner has the right to maintain it.
If the air filters are not changed, the next complaint you'll have is that the place is too hot or even worse, that your air conditioner is down.
They CANNOT enter your residence without giving you a 24 hours notice in writing...they need to give you a reason for the repair..so if it's the air filter, then I suggest you putting your cats in the bathroom for that day....they aren't going to die.
That way they won't get out as the maintenance person has no reason to enter your bathroom. |

They can try entering without your permission like they did to us last month. I came home and the furnace was ripped apart, no calls from them that they were doing this. I marched right to the office and said i was going to call the police for breaking and entering. Guess what, they apologized and said that there was a mis-communication between the maint guy and the manager. I said if there was anything missing I know exactly who to sue, I also requested an incident report from them which included a note saying that they will not enter our apartment unless we gave them permission 24 hrs ahead of time. Bottom line, let them know you mean business and they will back down...anything can happen and you got to protect yourself first... |

Legally they must give you 24 hours notice to enter your place wether you are there or not. UNLESS its an emergency. and replacing a a/c filter isn't considered one of those.
You need to notify the office they are required to give at least 24 hrs notice before entering your apt. |

Actually, no. You might think you can sign some paperwork that blocks entry of your apartment but it's not legal. Legally, the owner ALWAYS has right of access.
Most places will respect your DO NOT ENTER request, but it's not legally binding.
