Less than 30 day notice - tenant?
I live in MA. Tenant agreement states 30 day written notice (min). I received an e-mail on the 5th instead of the 1st of Jan '09. Are they responsible for Jan & Feb?
Additional Details
The contract reads this:
1 month prior to vacating property by end of last month. 30 day written notice required prior to moving. IE: Moving March first, must have written notice no later the February first (min)

The tenant is responsible through the end of February. The unit is rented one month at a time and not prorated on a daily basis.

Techically, yes, you can demand February. Most state laws call for a full rental period (plus the odd days). But if they co-operate and allow you to show the place and don't give any grief you MIGHT consider letting them slide, but you don't have to.

The tenant is responsible for 30 days starting from the date of notification. In this case, they owe you rent through February 5th.

UPDATE: OK, according to your contract, technically they are liable thru end of February. However if push came to shove, I doubt you'd get a judge to award that to you if you went to court.

Personally, I would push for rent through February 5th and leave it at that.

Since it was received/sent after the 1st, the notice would become effective on Feb 1 and they would need to be out by Feb 28.

Was the email dated Jan 1 and you just didn't receive it until the 5th.

The 30 day begin when it notice was sent, not when received.

Depending on the wording of the agreement, is it just 30 day notice or 30 days from the begining of a rental period. They could be responsible only until Feb 5, not the entire month of Feb.

That is perfectly legal. They are giving 30 days notice as of 1/5/09 so they have until 2/5/09 to be out. They must pay prorated rent for those 5 days in February.

30 days notice does not have to be 1st to the 1st.

a written notice must be served by the sheriff's department not an email! it must be court ordered. it's called a dispossessory warrant call the courts and find out what steps that a landlord must take to evict someone. do it anonymously!
