I have raised this matter on several occasions with the L/Agent who advised me that the clauses now mark N/A and initialled by both parties do not affect me but this is not the point I feel they should never have made changes without my prior consent Where do stand as I believe by doing this they have invalidated the Contract? |

I am a letting agent and this should not have been done without your permission. If you signed the original contract before they amended it then it is void. As it is your property it is your right to speak up and demand the contract is re-signed to its orginal specification. I suggest to you though, if the clauses are not crucial then I would leave it as it is getting harder to find tenants and you have also paid the letting agent. If however you feel that your property can be damaged due to the changing of the contract I would want it changed.

Anything that is changed, arbitrarily, by either party, renders the contract null and void, unless the aggrieved party is amenable to the changes and initials the changes. If you do not have a problem with the changes, I would still advise you to get the contract and initial your approval. Failure to do so will make the contract questionable if another issue arises. This will create doubt, doubt creates confusion and confusion, invariably, costs money. In short, allow nothing on the contract that does not have your approval in writing. |

I agree with Johnking. Neither the tenant/landlord/agent, can change the agreement once one party has signed. You are within your rights to have the agreement changed and the cost should be borne by the agent. If you feel the clauses are not a problem, but it is the point that they changed it, then I would write to your agent(always best) stating that in the Future, no amendment should be made to the agreement with out you prior consent.
When the fixed term as ended, ask they draw up a new agreement with the clauses back in.At their cost.
No agreement is "tweaked" to suit individual tenants, most agreements cover everything, and something that may not be relevant at the time of signing, may become necessary later in the tenancy. |

A tenancy agreement should be signed by
a tenant and the owner.
Letting agent or tenant can not amend or change
the terms and conditions without your consent.
if it is amended on their own will,the agreement
is invalid and it is a violation.
Prepare a new agreement and obtain the
signature of the tenant and witnesses.
Now it is valid. |
