My husband and I with our 1yr old son live in an illegal attic apartment... When we moved in we didn't think it was illegal until our friends told us it was when we have already moved in. (we have no fire escape and we pay no utilities because apartment doesn't have own meter)
We moved in with no lease but our landlord was telling us that they want to move into the attic themselves because the basement apartment isn't in livable condition for the winter and they are giving us till about Mid. Nov to move.
Is there anyway we can get more time to look? We really dont have the money to move at all and my husband is the only one working at the time... We just spent a whole bunch of money fixing our car so we're pretty tight.
Moving with a toddler in the cold isn't going to be much fun to begin with.

Since you don't have a lease you have no options. They are giving you plenty of time to find a new place though....they could've told you to by out by the end of the month |

I don't see why moving in the cold with a toddler would be a big deal. Bundle him up. Put him in the car. Drive to the new place. Bring him inside. Other than that, never move in anywhere without a lease. Best of luck. |

You stated yourself that things will be harder in the winter, it will be harder for your landlord too.
Have the baby stay with a friend or family while you are actually moving. Not only is the cold and issue, but you don't want them under foot where they can be hurt. Then move them after the fact. It should not be any harder on the baby then going to church on Sunday during the winter. Surely he leaves the house from time to time? |

You're lucky you're getting as long as you've got. It sounds like you're in a tough spot, but since the apartment is illegal, and there's no lease, the landlord can ask you to move at any time (up through however long you've paid rent).
Good luck! Moving sucks, and it stinks that your landlord didn't warn you when you first moved in that it was a warm-weather only arrangement. But you don't really have much recourse except negotiating with your landlord. |

i would suggest complying with your landlord bc being that you acknowledge its an illegal apartment and u refuse to leave the state can come and throw u out in less than a week for it being an illegal dwelling. i think 60 days is more than fair and i suggest complying with them, being homeless and cold is worse than moving in the winter with a toddler. smarten up! |

I sympathize with what you are going through. I live in California with a 6 month old, and I'm a first time parent as well. And totally understand. Correct, please take the baby to a family or friends home when the time comes to move. You will be irritable already, he will be unsettled with all the movement and it's just best. Pick him up the next morning, give yourself a break that night if you can.
Please dis-regard the remarks that are not giving you any help nor are compassionate to your situation. Correct.. let them evict you, it will give you more time. In the meanwhile, I've looked up some things for you. Try some of these and you can contact me at my email if you need any other assistance. I can sympathize with how you came to live in that situation, you and your hubby did and took what ever roof was available for your finances, though not legal, to keep a roof over the baby's head.. never ever allow someone who is not in your shoes nor will ever be in your situation to bring you down with heartless replies. No you do not have to move right now, you have the proof you been paying the rent right, make sure you keep that on yourself and your husband at all time, even some mail. If he wants to kick you out he must evict you and that takes time.
He has to give you time to move by law and the law is on your side.
Dont worry about it, if he doesnt give you a date to move via a certified letter, you dont have to move, it has to be written and has to go through court. When you go in front of the judge you tell your side of the story and what has been happening, and the judge will tell them they have an illegal apartment. In fact you dont have to pay rent on an illegal apartment, but if they accept it the landlord is in the wrong. You might have to call the housing inspector from your state to make a report on them.
Dont let them kick you out, a judge has to hear your side, and if you do go to a hearing dont sign nothing, no stipulation or anything else that may jeopardize where your livng right now.
Fight it out, it will buy you time.
Save money too. He,or she, the landlord must give you back your security deposit as well. This is illegal and unethical and I would fight it till the end in court.
Call the police if they try to lock you out, and once you have your papers proving you live there, show that to the police.
It takes time to move, let them evict you, in fact you can sue for back rent since the time you lived there, if they dont have a certificate of occupation anyhows.
Let them file for you to leave, save some money though. Pay the rent via check, and get a receipt.
Dont sweat it, if you must google.com new jersey law, and they are very strict to for rules. If else fails, you can get a just cause to avoid eviction saying you need time.
In the future becareful where you move, this landlord has in fact have to pay your moving expenses as well.
Like I said call the cops if they try to illegally lock you out. *that inself is against the law, and believe me your going to be able to sue the landlord for every day your lock out.
If I were you I would get some good information via google.com search for new jersey eviction proceedings, and if you need be, try to contact a social service agency out there that deals with housing. Either way your on the up and up.
