hi, i'm just wondering if there is any kind of "rule" for this kind of thing. i had scheduled for maintenance to fix some plumbing in my apartment for the early evening. i also told the rental office that i would call first. however, he came at 8 in the morning. he may have knocked, but i didn't hear because i was sleeping. and he just walked right in! i had to quickly shut my bedroom door and get dressed before walking out. it wasn't a maintenance emergency. so, my question is, do i have a right to say something to the office? i don't like the feeling that he can just walk in whenever he wants. any help is appreciated! |

Yes, you have a right to say something and if I were you I would, quite assertively too! They cannot enter your apt. without prior notice and to enter early in the morning after you told them early evening would work is just irresponsible. You should be quite incensed, I would! |

I would definatly notify the office, this is not permitted. There are cases when they can come in without your asking but unless its an emergency they have to give you advance warning. In my state 3 days. I would also get a security chain installed immedialty. Tell the office you want one asap. |

I use to do apartment maintenance for a few big companies.
What usually happens is the leasing agents write the work orders up and fail to tell the maintenance personnel that they had to wait to enter.
Trust me, the leasing agents at every property I worked at, always did this, and they make maintenance look bad.
Yes, I would complain, but to the property manager or main office. Don't complain to the leasing agents, because it will go no where. |

break out your lease agreement before taking any action. it will or should explain about maintenance entry to your unit.most likely they screwed up the appointment time.you did not specify the type of plumbing problem or apartment bldg.construction. if you are on the second floor or above and you have water leaking to units below then it's considered an emergency and maintenance will enter. you should have a security chain on your door,if not ask at the office about having one installed.to be safe get yourself a burgler bar to jam under the door handle at night. |

Your lease should give you the specifics either in the actual lease or in an attachment called Building Rules and Regulations. From my experiences, any time a maintenance man was going to do work in my apartment it was scheduled with me and if it was an emergency I was either called at work or left a message letting me know what was going on. I was also fortunate in that the maintenance staff was really good about banging down the door before entering. I would definitely call the management office and complain and tell them in the future you would like to have non-emergency visits scheduled to your convenience. After the phone call, I would follow-up with a letter that confirmed the details of your conversation. |

Well, I would think so. You are renting the unit. It is your castle. He should have knocked loudly. If no answer, the apartment manager should be there to acccompany him into your unit.(only after trying themselves to contact you, by phone or knocking on the door. The manager should be on the hook for this....for giving away the pass key. |

Most states require that they make arrangements prior to entering. If it is an emergency they may have a provision to enter without permision. |

Most leases state that they need permission to enter prior, though they can enter in case of emergency. I'd talk to the office about it. It could have been a simple misunderstanding, or it could be something more that they need to know about with that particular person. |

yes you should say something since he came at an unrequested time. only in an emergency can they come in without your consent but first they must notify you. if they can't reach you by phone or a knock (they must try both) then the landlord must be present and let him or herself in first. |

Sounds like you had made arrangements and they did not follow them so I would talk to them about this. Also I do not know where you live. There are state specific rules and there are national rules. So I would look for the National Realtors in your area and ask that organization what the rules are for your area before approaching your apartment management office about this issue. Know where you first stand before going in so you only discuss it once with them. |
