May I evict my husband's girlfriend from my house?
We're getting a divorce. We own the house together. He lives in the house for now. He pays the mortgage, gets the tax break and we divide equally the upkeep expenses. Now, he's moved the girlfriend in. May I legally evict her?

No, you can't. BUT you can take him to court and ask the judge to divide up the property equally -- your ex will be forced to sell the house and split the profits between you. Unless you have the money to buy him out of the house, which of course is another option. Personally, I wouldn't have paid for any of the upkeep to begin with since he was getting the tax break and certainly not if he has a live in girlfriend. You may want to rethink that aspect and discontinue paying.

if he is paying his part.. why evict her... are you annoyed with the fact that she is there.. what if he moved in a housekeeper. would you want it then.. or someone that was just there because they needed a home temporarily... you are getting a divorce. dont do things to make your husband not want to treat you fair.. you just want your half right.. so i suggest that you get a divorce.. calm down.. forget him and find someone else that you want just for them not because your husband has one.. remember to do unto others.. the....... ok gilermo

I don't think so...sounds like you guys are sharing everything perfectly and i think he has the right to have her in his part of the house. he sounds like a real scum bag though for moving his GIRLFRIEND to his wife's house. glad to see your getting a divorce.

Probably nothing can be done because it's in his name. I think it's in very poor taste of your husband to do this. He could at least wait until the divorce is final before he does something so tacky.

If he's moved her in then she should pay the upkeep expenses. Other than that, I wouldn't worry about her being there. Get the house sold or tell your husband to buy you out so you can have your share, then move on. I'm sure she's welcome to your leftovers.

No, looks like he is paying most of it anyway. If you do that, he will just move into a different house with her, but you can't anyway. You are not her landlord she has no lease with you and you don't live there anymore. When you divorce get the house out of your name, have him buy out your half, and move on with your life.

Wow kick them both out! What a jerk!

I think your going to have to contact your lawyer though to check on local laws because any answer you get here may not be correct for your area.

Good luck though I am sure that moving on from this is a good thing for you and you deserve better than somebody that would do this to somebody he claims to have loved.
