depends on your state, in Louisiana if he buys that house with you then his wife has ownership in it too and can legally take possession of it. so you better check with a lawyer first. |

Buying a house with a "boyfriend" ? Very Bad idea to begin with. He can walk at anytime and leave you stuck with the mortgage. Yes his wife can get her hooks into your place. It's joint property if his name is on it. ! |

Why isn't he divorced? Yes, she will own part of the house you are buying. They are legally married. What's his is hers and what's hers is his. I would NOT do this if I were you. You don't make a major purchase like this with someone unless you are married to them, end of story. If they divorce, yes, she could take ANYTHING he owns. ANYTHING. Even something he owns with another person. If he bought you a car and gave it to you but it was in his name, if she wanted it and the judge wanted to give it to her, she'd get it.
Why are you dating a married man? If he's not with his wife, why are they still married? My friend is dating a married man who "isn't with" his wife either, although they still live together and everything else. She's been waiting for it to be the "right time" for him to divorce her or at least kick her out for over 6 years. Don't be a fool. If you want to buy a house, fine. Make it YOUR house in YOUR name ONLY. |

Best option would be for you to not have to co sign until he divorces if that is at all possible. Maybe he should have her get served.
There are lots of pop culture references of people getting served the most recent one I can think of is Pineapple Express where it is actually the main characters job. |

In most states the wife would own part of the house that you and he are about to buy. In most states there is no way to prevent that without him getting a final divorce.

She would not be "TAKING" your house. She would be OWNING your house even if she is not mean. When you and your boyfriend decide to sell that woman would need to show up at your closing to sign papers because she will be part owner. |

Buying with a boyfriend/girlfriend is risky. To eliminate your risk, create a partnership and have the partnership purchase the property. In the partnership, spell out what happens:
1. If one of you gets disabled and are unable to continue paying the mortgage.
2. If one of you gets married or divorced, what happens to the partnership. You won't want her lawyer to come after the house.
3. If one of you wants to depart from the property (and the relationship).
4. If one of you dies.

it would be a good idea to get a lawyer involved. even if he wasn't married, i would want some kind of protection in place for myself financially should something happen to the relationship. |

I would definitely not want to make this transaction because it might backfire.
If you do decide to purchase with him contact a very knowledgeable real estate attorney.
It is difficult to mix money and a relationship and it is very hard to leave on good and equitable terms. |
