Mold in my apartment with infant, manger wont help!?
I live in Sacramento, Ca. { If that helps in any way } Me, My husband, and Our 11 month old son have been living in these apartments for almost 2 years, we transfered to a 2 bdrm about a year ago due to the baby, nearly 1 1/2 months ago my son caught pnemonia {sp} just a couple weeks before that we noticed { we live on the bottem floor } the people upstairs from us their A/C has been leaking onto ours { its not a swamp Cooler, its an Air Conditioner } well since its been leaking we have a big black patch on the top of our AC on OUR Wall, Its filled with water on the top, I told the Manager who lives on grounds about it 1 1/2 months ago and STILL NOTHING HAS BEEN DONE! I left 12 messages on her phone, I talked to her PERSONALLY 2 days ago and she said " the Maintence is on grounds today and will come look " HE NEVER CAME! I dont know what to do. I think thats what caused my son to get sick..I called city and county inspector, health services people, no one can help me!

Call a company who deals with mold and get them out there to inspect the inside of your apartment where that AC unit is. I'm betting there is mold spores in between the walls and yes that can make you sick and even cause death. Get that baby out of there ASAP as he is more susceptible then either you or your husband for respiratory problems. After the company does there report, file a claim in court. Your gonna have to do this so just go down to the courthouse and file the paperwork. Take all communications and pictures from your landlord, yourself and anyone else you have contacted about this problem. Write down dates, times, names whether by letter, phone or email. Take this all to court and present it to the judge. That landlord will have to prove that they did not know the problem existed or that they have had maintenance check it out. It's highly unlikely because that has been there for a very long time and has seeped inside the walls.

At the very least this will get the managements attention because they have to answer the court within 5 days. It may not go to court and they can not retaliate against you so you don't have to worry. If you have any medical records for your baby being sick take those as well.

Move out. You should be able to break your lease if you can prove you live in an inhospitable environment and your landlord won't fix it.

call your local health department, they would be able to tell you more if this is dangerous....also make a call to a code officer.... should be able to locate one thought you court building or city hall....

oh my gosh! That's really serious if it's concerning your son's health! Maybe you should talk to your neighbors above you about getting their air conditioner fixed so at least it stops the problem.

Get a lawer, and take legal action. If you don't want to take legal action, you should still atleast talk to a lawer. They can tell you what rights you have and what actions you can take. Good luck.

Call your city health dept and ask them to take a look. Send a copy of their report certified mail to your landlord and tell your landlord she has 48 hours to remedy the problem or you will take action and deduct the cost from your rent. If your landlord still doesn't respond, call a company who deals with mold and have them fix the problem. Send a copy of the receipt to your landlord with your next rent check, minus the amount of the repair. Keep careful copies of EVERYTHING, including your history of the landlord's non-action and your calls. The landlord may try to sue you for nonpayment of rent, but with these documents to back you up, she can't collect.

Or you can move and not worry about breaking the lease.

I'm no mold expert, but from the pictures, this doesn't look like any big deal. The mold seems to be on the exterior wall and exterior of the unit. Get some mildew remove and shoot it on the wall and on the exterior of the unit, then wipe it up. If you can't reach it, borrow a ladder.

I personally don't think this was responsible for your son's illness.

If you genuinely believe this is a health hazard, then move. Your lease should be up. It's obvious your landlord doesn't care. Move someplace where the landlord does care and maintains their property.
