Mom passed no will I live in the house 3 siblings. Who gets the house? ?

thank you all for your reply. I live in PA. My brother states that there is a way to get around the whole Probate thing. that if we all agree that we can divide everything between us and then I can possibly buy out the others or do a rent to own agreement untill I can afford a morgage.

The house is part of the estate, and will need to be probated. Because there was no will, the estate will have to pay capital gains tax on the house. Can you afford to buy out your siblings? You have a 25% stake in the house.

Once everything is sorted out the four children should end up with equal share of the house. However, if the house hasn't been paid off, you and your siblings will have to either continue paying the mortgage or sell the house, splitting the equity four ways.

Depends on which State ou live in, but usually the house and contentsare sold and money equally divided between the children. You're gonna have friction. Be ready. Let a Lawyer handle it.

No one until there is an estate opened. State will require some type of intestancy action to settle outstanding bills and determine who inherits. Odds are if there are no bills that require the sale of the house, you will each have 1/4. Equal right to occupy; and usually one party either buys the others out, or they sell and split the proceeds; or end up in a partition suit in court to determine what happens.

Her estate has to be probated. State probate law determines how the estate is passed.

Since there is no will, a judge will decide through probate. What happens in many cases is that the estate is split amongst the immediate next-of-kin, which means you would have to buy your siblings out of their share if you want to retain ownership.

You will most definately want to consult an estate attorney on this.

Hello Mav,
I am Realtor, not an atttorney. Here is the way it usually works, but I suggest that you consult an attorney (an initial consulting will probably be no charge). Having a will or not having a will the estate still goes into "probate" meaning the courts will decide, by will or next of kin, who gets the home & other personal property. This usually takes about 6 months. I would use this time to get together with all involved & talk it out BEFORE you go to the probate hearing. Usually the property passes like this: to the surviving spouse, if no spouse then mom's children, if no children then mom's sisters/brothers, etc down the line. (NOTE: eligible children have to be 21 years old or check with the state law) Example: 3 brothers/sisters = 33.33% equal shares. IF you all agree on the disposition of the home, then you will all have to decide what to do with it. If you are NOT all in agreement, then the courts will issue a judgment such as selling the home & dividing up the proceeds (after the mortgage or any other liens are paid off) to the surviving relatives. Remember, you should always check with state/ local laws.
