Mortgage question - keeping my name off the loan?

Talk with your lender. They may separate your credit from your husband's, however, if you're in a community property state, both of you are owners of the home, whether it's written on the deed or not.

So he may not get first time home buyer incentives anyhow.

You could purchase it in an LLC and have the LLC rent it to you. Ask a Lawyer to set it up for you. Form the LLC out of Nevada or Wyoming. Neither state has state tax so you will not be double taxed and you can transfer rights of LLC to any state.

Yes your husband can buy the home without you and vise versa. Now heres the but. If the lender cannot use your income he will qualify for less. First time Home buyer incentives may be available. Lender first time homebuyer incentive programs usually just require that on closing you don't own the home you previously purchased. Grant programs may require that you be a first time home buyer (off a deed for at least 3 years or be a displaced homemaker). Keep in mind although lender underwriting guidelines have tightened up a bit there are still lenders out willing to 'make you a deal' but it will cost you. Determine what you'd qualify for together with traditional financing then apart and decide how you wish to proceed. Getting financing is the easy part. Keeping the home now that's the trick.

The lender will require you "quit" your claim on the property before close of escrow. (Via Quit Claim Deed). Your husband closes the sale on the property. After COE (Close of Escrow), you add yourself to title.

He can buy the house on his own even if you are married. Sole and separate property.
Your name will not be on the loan or the deed.
After the loan is secured via his credit etc.. You can the go to the court house and revise the deed to include your name.

Yes, I did just last year. My husbands credit was better and also is was the major bread winner. All I had to do is if the home became foreclosed I needed to sign an agreement that I would leave the home as would my husband. There is no law stating that you need to be on the loan. Your husband can make a will that you gt the home if he passes away before you. This way there is no problem in you staying in the home.
