Addendum: My mother had the house built long before he came along. He has been living there since they married in 2003. The house has 3 more years of payments, I don't know if he is making them. I assume he is. |

He has the right to stay living there because he was her spouse. If he is making the payment, then everything is fine. If you don't like him, you need to get over that. Your mother loved him and out of respect for her, you need to treat him with respect. I assume that you don't want him living there so you can sell the house. |

I'm not sure by your blurb what your question is, but I'm guessing you are afraid that you will lose your inheritance (ie. the house). You will need to be more clear - who's name is on the title, did they have a prenup, did your mom have a will or living trust? If you go to the county recorder's office, you can find out who holds the mortgage - and then you can ask them if payments are current. |

You should ask him what his plans are and see if he plans to pay the mortgage payments. If he's not paying for it, then tell him that he should find another place to stay. I would suggest that you pay the mortgage because there's only three more years left. After three years, you'll have a house with no payments. |

What is the problem?? Your mother married him and I am sure it was because she loved him and he loves her. When people get married they share life and all the things that come along with it (even a home). I understand that your mom owned the house before he came into the picture but I am sure that she also wanted to share the material things with him. As far as the Mortgage on the house, it is up to him to pay the monthly payment, taxes and etc. If you are an adult then you should respect him as your mom did and move on with life. Good luck and I hope you get some help for what seems to be jealousy, resentment (that he is not your father) and animosity. The main thing is you need to find closure and simply move on!
