I was on a lease with my ex bf and less then two weeks ago and i had to remove myself off cause of school purposes for my son. At that time i was involved in a bad car accident and was not able to retrieve my belongings from the apartement. Now that i have a car he will not allow me to come get my things with help from my friends and polic escort. He thinks I will take things that is his or something. He is also saying if i were to bring friends to help me get my stuff that he will have them arrested for trespassing or anything else he can think of. So he expects me to get all my stuff including furniture on my own with no help. I have talked to the police and they have not really helped me at all. What can I do to get my things without any of my friends getting arrested? Additional Details thanks for the advice. i have talked to the police and they are going to help be ther so no fights break out. but now my ex is telling me i have an hour and a half to get my stuff and i am not allowed in the apartment and he will put my things out in the lawn. but i kow him and he will keep things he thinks will benifit him. even if they belong to me. |

The police are not set up for civil matters.
The sad part is this, he does not have to even allow them in the apt.
I have had to try and deal with this 100's of times over the years with residents.
About all the police can do, is stand by to keep the peace.
If you have receipts small claims court is your best way to go.
But, they will also say,"why didn't you take your stuff with you."
You are off the lease and have no rights to enter the unit.
As a landlord, I also have no cause to get into your problems with your boyfriend and cannot help you.
I cannot force him to allow things to be removed from his unit.
That is bad advice.
I do not agree with all of this, but that is the cold hard facts.
This is a pure 100% civil matter, those matters are handled in the courts. |

You can go to court and apply for an emergent order called "ORDER TO SHOW CAUSE" so that you can have access to remove your belongings.
The police will meet you and whomever you need to help you move, and if he doesn't let you in ... the police will break down the door and take him to jail. |

Talk to a different Police Officer or work your way up to the Chief. Tell them that they can talk to the ex BF now, or respond to a domestic dispute later.
He cannot just keep your stuff, that is theft. |

You can take him to small claims court. The judge will enter a time frame that he must allow you and whoever you need to help you move furniture. Ask for a police escort. |

The police should be able to direct you the best way to go. Keep talking to them and ask them what you should do. A different officer may be much more help. They are avoiding this issue because they don't want to get into a domestic dispute and this is how they see this.
A woman's shelter deals with this issue all the time, and even if there is no abuse you should get good advice from them. |

Tell him that you are bringing your friends to help you move and if he wants to call the police then go ahead as they will allow you to remove your personal property. The worse that would happen is that the police tell you to leave and take the matter to court. |

I suggest you file a police report and report him for theft. If you have furniture and stuff you need to get out then he cannot call the police on your friends because of the fact that the property is not owned by him it's owned by the management company. I suggest you call the on site manager and you tell him or her that you need to retrieve your belongings from the unit that some of it is furniture and you cannot lift it yourself, if you bring your friends to help does your ex have the right to call the police for trespassing? You need to elicit the on site managers help in this so there isn't a problem down the road.
Also tell your loser ex that he can be there when you remove the items so that there is no confusion as to what is yours and what is his and then he can't come back and say you took something.
I'd inform him that if he doesn't allow you and your friends to pick up your items at a time that is convenient to both of you that you will file a report for theft. See if that changes his mind.
He's just being difficult make sure you CYA by getting management involved.
