We're in the process of cleaning our apartment before our lease is up (Saturday), and we've noticed a few things. We've been at the apartment for 6 years now, and the carpet shows it. We've taken good care of it, but with 300 feet that are used multiple times a day, you can easily see and feel the difference between the carpet in high-traffic areas and the carpet in not so high-traffic areas. Now, I'm anal about cleaning so I run the vacuum once a day and spot it with a minivac a few times a day as well. We've had it wet-vacuumed twice a year for the past 6 years. That's just what we were instructed to do in our lease.
We were talking with a fellow who just moved out after 3 years, and they charged him for new carpet.
Is there anyway to fight this, or should we just accept that since we've lived there so long that we should count on paying an extra $300?
We're ready to be done with that apartment complex; that's all I have to say. |

As long as you've lived there, in most states, they CANNOT charge you for paint and carpet. It is normal wear and tear. They should NOT have charged the tenant that lived there for 3 years, either. Typically, any tenant that exceeds 3 years of continual renting, paint and carpet become normal wear and tear.
If you have the receipts from having the carpet shampooed, you can prove that you lived up to your side of the agreement, but in your case it's not necessary.
Please review your states landlord/tenant statutes regarding wear and tear. You will find all of your answers there. Furthermore, anything NOT found in your state's statutes is NOT enforceable in a lease agreement and a landlord is often subject to fines and other penalties for trying to enforce lease agreements not supported by a state's landlord/tenant statutes. |

Take photos of the area when u get everything out and if u can find a copy of your move in check list. On that check list it will say if your carpet was new when u moved in if it doesn't say that then the carpet is a lot older then 6yrs apartment complexes usually change out carpet in a unit every 3-5 yrs so if they do fight it do not pay that because they are trying to make u pay for new carpet so it doesn't come out of their budget. Be for u turn in your keys have either the manager of ast. manager walk the unit with you and put in writing whatever charges they say they are going to charge or that everything is OK with no charges DO NOT turn in your keys until you have this paper. The more money the complex saves by not having to spend budget money the bigger the bonus is at the end of the year in alot of management compaines. |

dont take it fight them on it and prove what youve done with the place. if you have saved recipets from when it was wet vac'd. use them too. |

Sounds like it's normal wear and tear as long as you take care of it and the carpet is clean, no tears/smell/spots, the landlord shouldn't charge you for anything. |

take allot of pictures when you move out, to prove your case, on the carpet if they deduct damages from your SD you may have to file in small claims to recover
In the USA, courts award damages not on replacement value but the value of the object at time it was damage, therefore they use a deprecation method to determine the value of the carpet
in most cases the court will allow for a seven year deprecation of the carpet, so in your case the carpet is at least six years maybe more, so if they try to charge you replacement value you have a very good chance of taking them to court and winning some of your deposit back,
since at least six years the carpet has little to no value thus they can not charge to replace, now they may deduct from your security deposit leaving your only recourse is to file in small claims
also in general six years is a long time much normal wear and tear do not let them walk all over you like with painting etc |

the best thing to do is to schedule a pre move out inspection with your landlord prior to your vacancy date. this way you can discuss any possible things that might be deducted from your rent/security. |

Wear should not be chargeable. If there are large stains, or tears, those are chargeable. If you have kept a clean apartment and fulfilled your agreement as far as the steam cleaning of the carpet, you are under no obligation to pay for new carpeting. Considering you have been there for 6 years, the carpeting should be replaced anyway, but not at your expense.

don't forget they will charge you for painting the walls too. The apartment complex is supposed to change out the carpet after about 5 years if it needs it anyway. so they will probably charge you for it since you were there the whole time anyway.
I lived in an apartment for one year and it was brand new- I never hung anything on the walls and there was never furniture pushed against the walls and the walls were in perfect condition when I moved out but they charged me $120 for touch up paint and to shampoo the carpets. I think it was a little steep but I was not about to fight them for so little $ in the long run. |

Hmm, well if you did what was required in your lease, I don't see why they would charge you. After 6 years, yes carpet will look used! It should be expected by them. If your carpet looked brand new, I'd wonder if you ever came home. Wait and see what they say, if they chose to attempt to charge you, I'd fight it. Especially if you followed your lease agreements.
Luckily, if there's any damage in my apartment, I just don't get my security deposit back - wouldn't matter, I'm not missing it. The apartment agrees to repair any nail holes, paint scratches, carpet wear, etc... every day use! without bothering us for extras... it is a really good complex though. Move here. =) |

Unfortunately you are at the mercy of the management company. Someone has to pay for carpet replacement and you can bet that they will dump it on you. This is a common thing and the tenant is always stuck with the expense.
I know it really bugs you and I have been there a few times. These companies have lawyers on retainer and seldom lose a battle as they are in the business and know every scenario. |
