My Girlfriends Ex-Husband of 12 Years Tricked Her Into Signing A Home Equity Loan. Can She Get Off?
She divorced him 12 years ago. 3 years after the divorce he refinanced the mortgage and took her name off. He never removed her name from the property deed. 4 years after the divorce he got a home equity line of credit and mailed her the signature sheet and told her she needed to sign in order to get off the loan. Total BS. He's started the process to remover her from the property deed. Doesn't he or she need a quit claim deed or some other instrument to remove her from the home equity line? She's not on the mortgage so the only liabilty is the revovling credit line. She's not real bright for sgining somethign w/o knowig what is was, granted. But, wouldn't a quit claim deed work or should her ex be forced to totally pay off and remove her name from the security instrument?

He can not take her name off unless he does it illegally or she is stupid enough to sign a quit calim form.

Then she tells him if he wants the deed she wants her name taken off the HELOC PLUS a nice sum of cash.

Basically, you're telling us she cosigned his home equity loan (because her name was still on the title). She needs a release from the mortgage lender, not her ex.

A quit claim deed won't do anything here. All that does is say "if I have any interest in it, it's yours." I could give you a notarized quit claim deed to the moon, for whatever you're willing to pay.

First step,Have her call the bank or mortgage company and explain the situation.
Next step,get a lawyer.

check to see if she is really obligated to pay it off. To be on the loan she would of had to of had her credit pulled and fill out a credit application. Check with the credit agencies as well. Something doesn't sound right here..she probably had to sign something just because she is still on the deed.

Probably all she needs to do is contact the bank where the line of credit is, tell them she no longer has any interest or obligation in the property due to divorce, and ask them what they need as justification to remove her. All I had to present was the divorce decree and property settlement agreement. Of course our revolving LOC was signed prior to the divorce, so if they catch that, she may still be liable, particularly if there is a balance or a poor payment history. At a minimum she can insist as a joint owner that any farther obligation toward her name be removed and it be closed, so he can't keep racking up bills in her name.

I think the the first thing that I would have her to do is to contact the home equity loan place and tell them what happen and what she did, but the real question is how long ago did this happen? If it is with in the three day period she can get out of the contract and say that she changed her mind, if it has been longer than that, than she really doesn't have a leg to stand on but to tell him to get the hell out of her home, she can be held responsible if some one gets hurts on the property, the next step that i would do is contact a divorce attorney and tell them what as happen, maybe they will be able to force him to sell the home and she can get half of it or force him to refinance the home equity loan just in his name only.
