While I was out of the country for a 1 1/2 months my landlord's brother was occupying my space with his friends. When my girlfriend checked in one time to get the mail she found a pillow that wasn't ours and other toilettries there. When I finally arrived back home I found my window was wide open and my air conditioning was gone. I looked outside the house and found it installed in my landlords part of the house. They had gone through my closet and taken out towels and pillows to sleep on. When I confronted my landlord he blatlently lied to my face saying he did not know where I was for the past month and that I did not put it in writing i was leaving. He wanted this months rent now or I would be evicted by the end of this month. I had told him and his whole family I was leaving and I even talked to them about paying the rent when I came back for the last month, and if there was a problem and they needed it earlier they could contact my girlfriend to recieve it. What are my rights? Additional Details I was planning to pay for the months I was away. I had left in the month of July and paid for that month. I informed the brother of the landlord( who I had originally signed the lease with , but then renewed when the landlord said he was the real owner) that I would pay August rent when I returned and if there was a problem and they needed the rent earlier I would wire the money to my girlfriend. The brother had said that there was no problem at all. But how am I suppose to pay for rent in August when they violated my privacy and used the space themselves. |

Wow, it sounds like you have one shady landlord. No matter what he wasn't allowed to go into your place to remove items without your consent. If he had been worried that you weren't around he is allowed to go in and check to see if anything happened. I've had to do this in the past and an easy way to check things out is to go look for milk or expired items in the refrigerator.
The proper course of action for him had he truly not known where you were would be to evict you for abandonment once he didn't receive the rent when it was due. In my opinion he obviously knew because what landlord in his right mind would just let a place sit empty without collecting rent?
Going in to a tenant's place like that and removing items without your knowledge is against the law. I would immediately take pictures of your air conditioned installed in his property and the other items missing and how you found the place. Good to have just in case.
This is where you need to decide if you want to continue living there. Technically the landlord is guilty of theft. You can call the police and report that your air conditioner and other items have been stolen while you were away. Let them know you see your air conditioner installed in another part of your building.
Another way to go about it is tell the landlord that you will pay the rent but you want everything returned that was removed from your apartment and that if everything is returned immediately you won't report the theft to the police.
Also, look at your lease. Most leases do have a section regarding planned absences of more than a week. Usually it does require that there be a written request made to the landlord about it. I understand the word of mouth but that just leads to a he said/she said in court.

Get a lawyer man! Without any written consent unless it was an emergency are they allowed to enter your premises. That is shaddy, I hope you took pictures. You can definetely sue them. You have renters rights. |

If you didn't get it in writing about the rent, it's his word against yours.
The good news: Consult an attourney. If you can PROVE it was someone in your apt. with the land lord's permission and not yours while you were gone you may have some legal recourse.
I would start looking for a new place to live ASAP though because the land lord can not be trusted to stay out of your place.
make out a police report for the "missing" air conditioner and anything else missing or dammaged while you were gone.
Next time you are gone for any period of time, make sure to make arrangements for your rent to be paid while you are gone and look into a house sitter to stay there while you are gone. |

Did you pay the rent for the month that you were gone? Or did you think that because you were not there you did not have to pay rent, but could leave your stuff there for the month and then come back, pay the next month's rent, and start living there again? Because you cannot do that. If your stuff is there, you're using the space and need to pay rent. Even if you are not physically there. And telling the landlord's family that you're going to do this does not change that fact.
Additional Answer:
You did not notify the LANDLORD. Telling his brother is not the same thing. You're lucky your stuff is still there at all! |

This is a very complicated situation.
In any scenario, the landlord is supposed to give you a legal notice delivered to your mailbox that requested the rent. If you failed to respond, they can take you to court and file to have you evicted. They can do this if you are home or not. By being in an arrangement with a landlord it is implied that you will check the mail and be home at least occasionally to handle business. Still they cannot lawfully enter your apartment without ruling from the court.
If the court rules for eviction, then the SHERIFF comes and moves your stuff out and gives the landlord permission to enter - only then can your LL use any of your remaining stuff as his own.
HERE IS YOUR PROBLEM...
If you were NOT current with rent suing him may be useless.
You will have to pay for an attorney, pay court costs and then when the judge finds out that you have not been paying rent, you will owe that to the landlord. So even if you win the suit the judgement will be that he has to return your stuff but that you also have to pay back rent. Under no unnarranged circimstance should you leave and not pay the rent for the time you're out. Their mortgages and expenses depend on your rent.
If you were current on rent then he is flat out wrong and should be sued! The burden of proof is on you however to prove that he did what you said. If you are back on rent this will look very bad and like an excuse for trying to prolong eviction. |
