Continue to pay whomever you have always paid. Make sure you get a receipt or in the very least, keep your cancelled cheque. Just because their situation has changed, it shouldn't affect your situation. If you paid cash, stop doing that. You will need to keep a record of your payments in case this goes to court, which it probably will eventually. If you have a lease, check out who signed the lease to rent to you. In all likelihood that is the rightful owner of the property and the one who should be receiving the rent. |

Talk to a lawyer before you do anything. If the divorce settlement includes the house in which you live, some official disposition will have to be made - it will either belong to him, to her, or will be sold and the proceeds split. You might have to set up a special account, in trust, and pay your rent money into that until their divorce is settled and you can give the money to whichever party the court stipulates. |

get it in writing. Writing will hold in the courts. Talk is useless - don't trust any words unless it's written on paper and signed.
If you get screwed over because of them, you can bring in the signed paper to save your butt. Just make sure whatever the arrangements, that it's legal. |

I would contact a lawyer as soon as possible. That's a really sticky situation. On their end, there should be a temporary (legal) agreement that specifies how such matters are taken care of until the divorce is finalized. |

You pay the rent to whoever your lease or rental agreement says to pay until you are officially notified in writing by the court or landlord's attorney that you are to do differently. Do not pay with cash and use checks so that you will have proof of payment. |

tell them based on this, both parties would have to write a letter agreeing to give the rent to one specific person. they would both have to sign, until they work it out you should put the rent money into an escrow account (interest bearing) instead of giving rent money to one specific person. this proves u have every intention of paying rent you just need to find out who. |

you didn't state which state you are in...but if neither party is offering court papers to you...then i would do the following:
1. put the rent in a special savings (escrow) account
2. write a letter immediately to both, send it return receipt certified....tell then in this letter that both have requested the same and that until you receive a court document the funds are being held in escrow. you are more than happy to pay the rent - but do not want to be part of their squabble.
3. contact Renters Rights or Renters Advocates (look in white pages)...or legal aid. these people will give you proper direction.
4. also keep a journal of dates and times you are being contacted by these two regarding this.
if you get taken to court by wither one, you can prove, that they both asked for the same thing, you had no proper paperwork from the court and you had a journal and proof of your letter.

I would ask to see a deed before making the check out. It's your right not to have to spend money on a lawyer or going to small claims court. It's your right to know who the owner is without dealing with being in the middle of a fight between the couple, especially since one of them has obviously lied to you! |
