Ranger4402 | My Only Option is To Move? |
I am on a month to month rental agreement.
My property owner won't offer leases.
Last night he knocked on my door.
He said to me, "I am evicting your neighbor for non payment of rent. Please serve them the court summons for me."
I feared if I did not do that, then he would terminate my tenancy and give me 60 days to move under state law.
I knocked on my neighbor's door. He answered. I asked him if he was "John Doe" and he said yes. I then said, "You've been served." I handed him the summons.
I am not one to sue people. But I've got a very negative feeling about this. I like my neighbor. I am sorry he is in a bad spot and can't pay his rent. I know my apartment owner is not running a charity. He should get paid his rent. I also know it is not my obligation to help the owner do his job. He should have hired a process server. The on site manager was out to dinner so that is why he asked me to serve my neighbor. The owner should have waited for his manager to get home from dinner or serve the tenant some other day.
I don't want to move. I like where I live. But I have a real bad feeling about this. I don't want him to retaliate against me if I tell him to never ask me to do that again.
So I guess my only option is to move?
Please don't tell me to sue him because I don't think the owner did anything legally wrong. He never threatened me with retaliation. |

Why would we tell you to sue? There's nothing you can sue for!
If you don't want to do this again, then when the landlord asks again, nicely tell him you aren't comfortable doing it.
"Mr Roper,
I'm really flattered that you trust me enough to put something so serious in my hands, but I just don't have the stomach for it. I'm losing sleep over it. I really enjoy living here and I really like having you as a landlord, but I just can't do this for you."
If he decides to give you notice, then he decides to give you notice. Know your rights. |

you can say no or yes. there is no law that you have to serve anyone for their purpose. this is a free world, you are not a wench, or a slave of other, so kick your butt first, don't be so paranoid. your only job regarding tenancy or renting there is to pay your monthly dues and no more. well, except of course, if it is in the contract that you will serve tenants for the landlord when needed AND YOU SIGN IT.... |

You are over thinking this. You do not need to move, have nothing to sue over and are not involved in the eviction of your neighbor. Don't feel bad for them, they are trying to steal someone elses money, thieves should not be pitied. |

Your landlord didn't threaten you...you ASSUMED he would evict you. Maybe he asked you to do him a favor because he trusted you.
You are blowing this up in your head...a better option is to sit down and just have a friendly chat with the landlord that you agreed to help him this one time, but in the future, you would prefer to keep things professional and not get involved in his affairs.
He didn't do anything legally wrong...however, the tenant can claim that he was improperly served because you are not a party to the action nor an officer of the court. |

You are right. The owner did not do anything wrong. He's a cheapskate, but he's not dishonest. Basically, he just saved the cost of a professional process server.
At this point he owes you a debt of gratitude. If he asks again, be honest with him. Say that you'd really rather not do it to someone you know and like and that, being the type of person Mr. Owner is, he will surely understand how you feel. Say it with a smile.
Don't worry so much. If you pay your rent on time, are a good, quiet tenant and take good care of his property, why in the world would he want to evict you? You are a dream tenant! |
