My apartment complex advertises granite counter tops, yet only some of the apt's have them. Is this allowed?
We pay just as much as people with granite counter tops, yet we do not have them. On their flier, and website it says they have granite counter tops. I was wondering if this is illegal due to false advertising, or simply unethical because they misled me. Also, our counter tops have knife marks and stains which we will probably be charged for, but if we had granite this would not have happened. Any ideas on what I should do?

This is legal, just like saying "ground floor units", "3 bedrooms", "mountain views", etc.

As long as the description applies to some of the units it is legal to advertise it.

Just because someone else has something you don't have doesn't mean that it's unethical or illegal.

If you have been promised granite when you signed the lease and didn't get them, you would have a case.

The condition of the counter tops was the same as when you moved in. It was ok then, so why not now? You told the apartment and agreed to the price and terms. Get over it.

They can advertise anything as long as they have at least one unit where that is an option. They can charge anything they want for each unit. You agreed to that specific unit for a set price, therefore your lease is fair. Stop being jealous of other people's deals, if you want something better then negotiate and look harder when your lease is up.

You viewed the apt. before signing the lease didn't you? If so, you were aware the apt. you rented didn't have granite tops. By signing the lease, knowing the apt. didn't have granite counter tops, you made an agreement to rent the apt. without granite counter tops.

The time to request a different apt. was then, before you signed the lease on the apt you have. Now you are stuck with what you rented.

Legally, they can advertise granite counter tops as long as they don't say every apt. has granite counter tops.

If they have apartments with granite countertops then they can advertise that they have apartments with granite countertops. It is not false advertising.

If you were shown an apartment with granite countertops then were given an apartment without granite countertops then it was false advertising.

If you saw the same apartment that you are renting (without granite countertops) and signed the lease then you have no reason to expect granite countertops because you saw what you were getting and agreed to it.

What you can do is ask the apartment managers if you can move into one of the vacant places that have granite countertops. If you have been a good tenant they will most likely agree to keep you as a tenant.

If you caused the knife marks on the countertops then you will be charged for their replacement or repair. The reason for this is that you shouldn't be cutting things directly on the countertops. Even if you have granite countertops you are not supposed to cut directly on them.

Cutting directly on soft countertops (laminate, wood, formica, etc) will damage the countertops. Cutting on granite countertops will damage the knife.

Use a cutting board. they are cheap and save a lot of damage.

NO - NOT illegal to advertise that way as long as they are not saying that ALL units have them.

You agreed to take the unit without them when you signed your lease and moved in - so there is nothing you can do about it now. Stop being jealous and deal with your agreement.

Knife marks: YES, you will have to pay for the knife marks but that has NOTHING to do with if you have granite counters or not. You should be smart enough to know not to cut stuff on the counter. You should never do that no matter what kind of counter tops you have. You can get a cutting board for a freaking dollar. Stop being cheap and do what your supposed to do.

Didn't you see the counter tops before you signed the lease? If so, then you knew what you were getting. If not, next time don't sign a lease for an apartment you haven't seen.

Nothing illegal was done by the complex. It's not false advertising since some of the units do have granite.

P.S. Use a cutting board instead of your counter tops and you won't have knife marks and/or stains.

Depends on how it is worded. Post a link to the site. If they say some apartments have granite that is ok. If they are advertising that all have granite then that is false advertising.

Yes, this is false advertising, misrepresentation and probably a few other things and you may have a claim IF you have not yet agreed in writing to accept the premises as is and IF the limitation period for bringing a small claim has not yet expired.
