My apartment complex owes us $3000 dollars but changed management and now won't pay. Is this legal?
We paid for something that was $3000 and got it in writing that our apartment complex would pay us back. The new manager says that since the old management made the deal, they don't owe us.

yeah, they owe you. You will have to go to court to get your money. You also have to consider if the old management claimed bankrupcy - it could be a little harder to get your money then (my sis went thru that). You also have to find out who wrote the note and if they had any authorization to actually write it. If thats all legit, then sue.

In any sort of sale, the security deposit (I assume that's what you are referring to) transfers to the new owner. If it was just the property management that changed, the same condition would apply. So yes you should get it back from the new people. If it didn't change hands that's their problem, not yours.

The old management was under a different corporation, most likely. The new one is a different entity that bought it out, even though it's the same name and place. Corporations are formed to separate themselves from liability. You must act fast and research the old management before they declare Bk or dissolve the company. You are entitled to that money as long as it was stated in a contract or in writing, but you have to act fast before they consider it a write off. If they have already dissolved the company you would have to take the CEO/Corporation to small claims court, but good luck with that. Hopefully their company moved on to new investment opportunity's and had a good opportunity to sell, and are still in a good standing. Then you have an even better chance of getting your money back in court. If you find they are still in business do not let them prolong you from getting your money, or give you the run a round, they can be just delaying to file Bk. Serve them with court papers once you locate them.

when new management buys soemthing, they typically agree to take on the outstanding debt. what you need to do is tell them you've talked to a lawyer (even if you haven't) and that he's advised you of that and that for that amount you will file a small claims suit if you don't get a check within 4 weeks. tell them you'll sue for mental anguish, punitive damages too, b/c if your going through all the damn trouble you want 5 grand which is usually the max, depending on your location

If it is the apartment complex (the business) you made the deal with, the new owners have no choice but to pay you back. When they took over the business, they took over all aspects of it, including their debts. Legally they have to pay those debts. If the last owner wronged them in some way by not making them aware of this, they would have to go after the previous owner in court. Legally they still have to pay you though.

Take them to a small claims court, you will win.

Thats not true. Your agreement is with the apartment complex and once they take over, they still have to abide by the agreement. You can take them to court and get the money, make sure to bring all your proofs.
