paige | My apartment lease - 30 Day Notice? |
My lease ends today Jan 31 and I want to move out. Am I required to give 30 day notice. If i give the house key today, Am I still responsible for Feb's rent? Pls help.. what is the law says? |

If you are a month-to-month tenant you must give 30 days notice, so yes, you'd owe for all of February.
If you have a regular lease, you are responsible for whatever the lease requires. You should either have agreed to stay (maybe going month-to-month) or given notice. WHAT did you and your landlord agree on? |

PAIGE, YOUR LEASE DICTATES THE LENGTH OF THE LEASE AND IT ENDS ON THE LAST DAY OF THE LEASE...SO YES, YES, YES.!; LEAVE IN PEACE AND YOU WILL NOT BE CHARGED.
THAT IS THE REASON FOR A LEASE, IT DETERMINES THE LENGTH OF THE LEASE AND ESTABLISHES THE RENTAL FIGURE FOR THE TERM.
NO NOTICE REQUIRED, TURN IN YOUR KEY AND DO A WALK-THRU SO YOU CAN GET YOUR DEPOSIT BACK |

Yes you are required to give a 30 day notice. If you knew you would be leaving on Jan 31, you should have given notice on Jan 1st. If you did not give notice they landlord can legally ask for February's rent |

Your answer should be spelled out in your current lease. Usually when a lease expires, it's terms and conditions continue on a month to month basis. |

You really need to read your lease to find out. At the apartment community i live and work at you are required to give a 60 day notice. The lease does state you are required to do this even if it is at the end of your lease. Even more if you don't give a notice your lease automatically renews at month to month until you give notice. When you go month to month this usually ends up making the rent go up higher. Depending on what it states in your lease if you just giving them the keys and move out you can be responsible for a reletting fee and accelerated rent through your notice. Not paying this can result in it going on your credit then making it difficult to lease an apartment anywhere. Read your lease, if you don't understand what it says go into the leasing office and talk to them about it. They will be able to clear anything up for you, just know that you have signed a legal document and you are responsible for knowing what it says in there and what you can be held to. |

It should state it in your lease, but I'm assuming yes your landlord/leasing company will hold you responsible for February's rent. I would talk to the landlord/leasing consultants and see if maybe they can rent out your apartment now (or provide someone who wants to rent it out) so they aren't loosing money. Good Luck! |

Legally they can make you pay for the month of February. It depends on how cool your landlord is. I suggest don't sign the lease, pay for the month of February as a month-to-month tenant, and move out at the end of February. That way, you'll get your security deposit back. |
