Ok, OBVIOUSLY a lot of people posting have never tried to evict someone from an apartment before.

A court WILL NOT even accept a move for eviction unless you are a full 30 days behind in rent...REGARDLESS of what is written in the lease.

They WILL NOT accept it for only one day...otherwise the court system would be clogged with these cases.

They can hang anything they want on the front door b/c it's not your friend's property.

Tell your friend that not having rent with a new baby is not a good thing....just pay the rent (by check, not cash) and inform the landlord you are not leaving, HOWEVER, if your friend is only month to month, the LL can ask her to leave with a 30 day notice for any reason.

That is why you never rent a property month to month.

10 days late is a long time. In most states the landlord has the right to commence an eviction if the tenant is only 1 day late.

Yes, it is legal to post a "pay or quit" letter to the front door.

Your friend should have made arrangements to have her rent paid while or before she went into the hospital.

Yes, its legal for the eviction notice to be posted on the door.

Yes, its legal for them to evict after 10 days late, unless there is a grace period guaranteed in the written lease, the landlord can start eviction when the rent is 1 day late.

If your friend was in the hospital for 6 days, and is now 10 days late on rent, then she should have paid the rent 4 days before she went in. That will hurt her chances of getting sympathy from the landlord.

It is supposed to be taped to the door, but I do not think any one will worry about it being "hung".

Yes, it is legal to start eviction as soon as the rent is late, one day late is good enough. The courts do not want the landlord to get screwed too badly if your friend is a dead beat.

Yes and yes, the property manager should give a 3-day or quit 24 hours after the grace period is expired. They should start the eviction process if the 3 days pass.
Your friend should contact the property manager and explain the circumstances...hopefully they will be understanding and willing to work with her.
She may ask a church or social organization with help paying her rent[ and negotiating on her behalf]

Yes, and that is the right thing to do. 10 days is a long time to be late. More than likely the landlord has to pay the mortgage on a certain day and has now been penalized. Which means that he may have had to pay upwards of 200 in late fees. If it were you, you would do the same. I would also expect for him to take your friend to court.

YES- posting the notice is standard. It is NOT the landlords fault they were not home to get it.

YES - it is legal to evict when 10 days late. They can evict at 5 days late and 1 day in some states. How long did they think they could live there for free?

I understand having been in the hospital and the baby and everything - but they knew when the rent was due and I'm sure the husband or a friend would have been happy to drop it off for them. So that is no excuse.

EDIT: Expert Realtor is the one that is wrong. At least for Oregon. The laws are different from state to state. Here we can serve a 3 day notice for nonpayment of rent only and we can file with the court on the 4th day. That is true for most states, so I don't know were this self proclaimed expert is from.

Yes and Yes, but is not likely they would do this unless they are late continuously for over 6-7 months. If it was the first time they were late NO 2nd prob not but if they are late every month YES and they will. And an eviction letter can be posted to the door. If they are not out within the time frame then the cops will be called to enforce it and then they will have 3 days by the court. That is pretty standard in more states.
