My boyfriend and I have a house, We let some family stay till they could find some other place: Sex Tape.?
They were supposed to pay us $100 a month, (great deal by the way) Which they have not did ever. I somehow misplaced a very personal video of my boyfriend and I messing around, which they now have, and are watching and showing other people, even old neighbors! How do I get them out and my tape back? There was not a lease, just a verbal agreement, Please help me.

Why would anyone want to watch a family member have sex...thats just weird...
Anyway...just ask for the tape back...you should always assume that those tapes will get out and delete after watching them...

Put all of their stuff on your porch. Go to the police. File a harrassment charge, theft charge and restraining order. These people aren't "normal" or they wouldn't be watching relative porn and you are not likely to get the tape back without help from the authorities. Don't worry about making them too mad to give the tape back, it is likely that they will not do so on their own. I know it sucks, but get the police involved.

Friendly
Just kick them out. They are not renting off you they are basically staying there for free. U are letting them stay there for free and they are basically chipping in money for food. That is just wrong. Try to talk to one of the neighbors and see if they can ask to see the tape and really give it back to you or call the police. U should have no prob throwing them out but getting the tape back might be harder. Good luck. Nice family- disown them losers.

Elizabeth R
I would tell the family member that the tape is a very personal and private matter that they should have never got involved in to begin with. Ask for it back face to face so they will hand it over then...if not, copies can easily be made then they would give you the original back. Tip of advice: dont make any sex tapes, they always come back to haunt you.

Jester
no lease , no rights !!!

just walk in and throw everything out on the street.

and hope you find the tape first.

while revenge is sweet and rage provides motivating force, it doesn't make your actions legal.

google your state's tenant laws. ["{state} law tenant"]

look for anything about evictions and unpaid rent.

then google your state's laws about "adverse possession".

follow the law.

if the tape is as you describe, then showing it to others is arguably pornography. [you and your bf viewing it isn't.] there are laws against distributing pornography if you need to get that serious. it would require a police report and all the usual aftermath.

felix v
you tell them that what they are doing by taking advantage of your hospitality is wrong and that they need to go! and as they leave also call them wierdos for watching you guys on tape! LOL

It would be great to take out all kinds of revenge on them, but let's deal with what you can feasibly do without getting the police or lawyers involved. This will only make the situation worse.

1) Go through all their stuff and get that tape back. Hopefully they haven't made copies. Be really nice to them until you get it so they aren't on to you. You need it back so that you know they can't do anything else with it (like post it on the internet).

2) Tell them it's time to leave. Give them 2 weeks to find a place and get out. If it's your family - you tell them. If it's your bf's family - he tells them.

3) If they don't leave, change the locks. They can make an appointment with you to get their stuff back. Have their stuff packed up in boxes and suitcases at the time of the appointment and waiting for them on the porch. Tell them if they don't come get it - it will be in that week's trash.

I'm sorry this is happening to you. From now on, follow this golden rule - NO EVIDENCE! Don't take pictures or video of yourself in any compromising circumstances.

You need a lawyer to send them very official looking threatening letters, regarding the tape first.

When you get that back, kick them out.

Just set the place on fire when they are asleep and run....j/k

Get the video back when they aren't around. And then give them the boot.

Mugwug
I'd definately check the laws in your area, but frankly my initial reaction is that you should tell them in no uncertain terms that you want the tape back immediately or the locks are going to be changed, and they'll find their belongings outside in 30 minutes.

Once the tape is back , I'd explain that since they've proven themselves such respectful house guests they have 5 days to find themselves other arrangements.

I think that's a generous offer considering you have received NO consideration (monetary or otherwise) for providing them with room, and presumably board, and they have in fact STOLEN from you.

Good luck.

kick them out, if they don't leave-have them arrested for trespassing. i'm sorry about the tape--but never video tape something you wouldn't want other people to see!!

Cup of Joe
call the police. Tell them you have informed them to leave. they refuse to. Since there is no contract they have no renter rights and they can be considered trespassing. Or change the locks one day when they are gone and put their stuff out on the lawn. Personally I would do the second one, but make sure you have proof of telling them to leave for that one. you don't need it to call the police.

financing_loans
Call the police. Charge them with theft. Copyright laws ect. Its not about you getting the tape back its about the police showing up and them facing jail time.

PS I saw the tape. Not bad. Just kidding

I'd need to see a copy of the tape to render an opinion.

it is theft period invasion of privacy , so on so forth . ask for tape back . and if a copy is made , copyright infraction . the law has been broken , kiss the rent goodbye . if you have to a)CONTACT POLICE B) file civil suit and small claims court they will lie the more they lie the more money . it sounds like my wifes family they put the fun in dysfunctional . pardon me your ex family . lots of profanity going through ancient brain . another legal option available to all citizens you can kick there door in and take it , under the suspision of firearms or illrgal substances . this is sick did not realize still in home call sherrif for unnanounced eviction sherriff there ask them to hand tape over to you well the sub humans are being evicted . you do have the right to search al property as it leaves point tape and other objects out to sherriff and they eill confiskate and return to you . to bad you could not stash 10 lbs crystal meth in thier possiens . dont do that one you would be in trouble . good luck this you will never forget . they will need your kindness soon . no luck there part good luck now you can rest .

If they never paid you and you never deposited any money from them, then you're free to clear them out anyway you want.

Since there was no renumeration, there was no meeting of the minds, therefore no evidence of agreement to let them live there.

You own the home.

You can file trespassing (which would get kicked by a lawyer, but will scare them and can get the police out to the home a couple of times).

Harassement and restraining orders are also tactics to employ.

However, these are family members. Before you go legal, you might just ask them to pay up and then leave. Also ask for the tape back.

You might also start talking to other family members not living in the house. Maybe tell a horror story or two to brothers, sister, and close aunts/uncles/cousins. You don't have to mention the sex tape, but if they ever spent a summer with an uncle, maybe make a joke had how they must have been terrible to live with even when they were a child.

Sometimes a little family pressure can move mountains. Also, this protects you if they go to the larger family and start bad mouthing you, saying you said they could live there and then kicked them out "for no good reason." If you've already let a few people know that they are the problem, you won't feel family pressure coming back at you...

Look into suing them for defimation of character. Looks as though you could win.

Take your video recorder and secretly record them messing around. Tell them that unless they get out now and give you your tape back, you will show it to everyone you know.

Lola
I think, not sure but you'll have to give them an eviction notice to get them out. They'll have so many days to move out. If they have something that belongs to you then that would be stealing, and if you decide, you should take it up with your local law enforcement. Not much else you can do about the tape. That sucks!! Feel for you.
