Are you on a lease or do you own the home? As long as there was no lease this process is simple but can take some time.
You need to get an eviction notice; which you can find at places like Office Depot. You need to mail the eviction notice to your residence to him. Make sure that you certify the letter and insure it at the post office. Keep the reciept from the post office and the copy of the eviction notice. Make sure that it will be delivered to him when he will be home, he will have to sign for it.
If that does not work, then you will need to publish a small ad in the classifieds of a local newspaper. Make sure that the ad says " ________(his first and last name, middle int. or name if possible), you need to contact _______________(your first and last name, and middle int. or name) immediately concerning you residence at _____________(whatever the full address is).
You also have the option to hire a company that delievers letters to people; not the post office. Make sure that the individual and company are licensed and bonded with the state that you live in to be able to serve him with the papers at your residence or at his work; IMPORTANT: Licensed and Bonded.
Whatever you do, do not go to his work directly or hand him the eviction notice with it being mailed. You need to protect yourself, because if he is a jerk then he will lawyer up. If you do end up going to court make sure that you have a copy of everything, especially if you do an ad in the paper. Contact an attorney if this situation goes to court. You can also keep my email and let me know if it gets bad; my parents were landlords for over 17 years.

You can try asking him to leave and maybe he will. He will probably need time to find a new place.
If he doesn't leave on his own, you have to follow the legal procedure in your state which would probably involve giving him official notice (usually 30 to 60 days) and if he hasn't moved by then, you can file for eviction based upon the fact that he is a holdover tenant.
Don't you have enough respect for him to sit him down and tell him that you want to split up and that you would like him to leave? |

Be as honest as possible, straightforward and stick to your position. If it becomes emotional, or you get scared, call the cops. It might not hurt to call a friend and let them know that you are about to talk with him and that you will call that friend back in twenty minutes. If they dont hear from you, they should come over. |

Simply tell him that the relationship is over. Let him know what the problems were (he deserves that after 3 1/2 years), and that you can no longer be with him. Be firm.
If he refuses to leave, the police can have him removed, but try not to come to that scenario if possible. |

If you have concerns about speaking with him about it, such as he will refuse to leave, then I would tell you to consult a local real estate attorney.
Since he has been there so long, he may have some rights to access. Each state is different, so speaking with a knowledgable attorney should be a great help to you...

Do you own the home or is it in both your names? Give him a notice (a month) as to when you want him out and put it in writing so you have documentation. Make him sign it if you must. Don't expect him to start packing the moment you tell him. That's not fair. If he's not out by that date contact the Police Dept and ask for an escort and restraining order. If he is on a lease or deed or anything legal, sorry but you got into that one. He will have to go voluntarily. |

Is his name on the lease? If not you should be able to get him out. If he is on the lease talk to the landlord to see if you can get out of the lease and move. If he is not call the police and tell them he is not on the lease but will not leave, they will tell you what you need to do in your area. Good luck. |
