It depends on the state in which you reside. Real estate laws are different from state to state. So far go_lc_bears has the most correct answer with one exception: in some states (and dependent upon your lease) you cannot make repairs and charge them back to the owner.
Get her lease contract out and read it. Unless it says specifically in it something regarding the windows have to be able to open, it might not even be considered a problem according to the lease.
Your best option is to contact a local tenant's council. If you do not have one in your city, check out the next closest large city.
You might also be able to get some other options from the state agency which regulates real estate law, in Texas that is the Texas Real Estate Commission. Usually the state cannot give legal advice but can refer you to resources where you can find your own answers.

It would seem to me that your daughter could have the windows repaired and withhold from her rent what it cost her to have the repairs made. Of course she must show in writing the amount of the repairs and submit invoice along with the balance of that month's rent. Retain copies of invoice and canceled check or money orders etc. for her records. This would be sufficient if called to court for partial payment of rent. |

I just wanted to clear up some things from other posters.
If there are 2 exits from each room, there is no fire hazard, no matter how many other windows may be stuck closed.
Avoid witholding your rent for any reason. It will only lead to trouble. Late fees, and evictions.
Make any request to your landlord by certified letter so you have proof of when you requested it. If he has not responded in about 2 weeks, you can make the repairs yourself, and send the bill to the landlord. If he still doesn't pay you, take him to small claims.
Is it honestly that hard to get a razor knife and cut the dried paint and lift your own windows though? |

Contact your Health Department and or City Hall to put in a complaint of repairs that are still needed.Maybe,depending where the property is located the landlord might qualify for a grant through HUD for windows or Economic Development for any Block Grants availbale to enhance the neighborhood.

call the lanlords assocation. they will help you. thats why you pay rent. if they arent able to help, call a lawyer to see if you are in your rights to withhold your rent untill its fix. |
